Ցանկացած ծեծ, բռնություն որակվում է որպես հանցագործություն: Այս մասին այսօր՝ հուլիսի 7-ին, ԱԺ-ում լրագրողների հետ զրույցում ասաց ՀՀ գլխավոր դատախազ Արթուր Դավթյանը՝ անդրադառնալով «Սասնա ծռերի» անդամների նկատմամբ դատարանի նկուղում կիրառված բռնությանը:

«Դեպքի վերաբերյալ ոստիկանները ներկայացրել են համապատասխան զեկուցագրեր, գործով ամբաստանյալներն ու նրանց պաշտպանները համապատասխան հաղորդումներ են ներկայացրել: Այդ ամբողջ նյութերը մեր կողմից ուղարկվել է Հատուկ քննչական ծառայություն, որտեղ իսկ արդեն հարուցվել է քրեական գործ եւ ներկայումս իրականացվում է քննություն: Մեղադրյալներ չկան»,- ասաց գլխավոր դատախազը:

Լրագրողների հարցին, թե ինչու նմանատիպ գործերով մինչեւ օրս որեւէ ոստիկան չի կալանավորվել, Արթուր Դավթյանն արձագանքեց. «Ցանկացած դեպք, որը կլինի թե ոստիկանության, թե դատախազության կողմից կատարած արարք, օրենքով ունի նույն գնահատականները: Մենք պետք է ունենանք բավարար ապացույցների համակցություն, որ որեւէ մեկին մեղադրանք առաջադրենք»:

Դատախազի խոսքով, թեեւ բռնությունները ֆիքսված են, բայց թե այդ բռնություններն ինչ հանգամանքներում են եղել, դրանք կպարզվեն նախաքննության ընթացքում: Հարցին՝ իսկ ոստիկանն իրավունք ունի բռնություն կիրառել ամբաստանյալի նկատմամբ դատարանի նկուղում, Արթուր Դավթյանը պատասխանեց. «Գնահատականն այդպես չեմ կարող տալ, Ոստիկանության մասին օրենքը նախատեսում է ոստիկանի կողմից ֆիզիկական ուժի կիրառում, եթե կան հիմքեր, եւ այդ հարուցված քրեական գործի նպատակն է պարզել՝ արդյոք անհրաժեշտ հիմքեր առկա եղել են ֆիզիկական ուժ գործադրելու համար եւ արդյոք համաչափ ուժ է գործադրվել»:

Հիշեցնենք, որ հունիսի 28-ին, Երեւանի Ավան եւ Նոր նորք վարչական շրջանների ընդհանուր իրավասության դատարանի խցում «Սասնա ծռեր» խմբի անդամներից մի քանիսը բռնության էին ենթարկվել: Բարձրացած աղմուկից հետո ո ոստիկանությունը հայտարարել էր, որ իրենց կողմից համաչափ ուժ է կիրառվել:
