Այս 19-ամյա աղջիկը բռնաբարության զոհ է, սակայն նրան 30 տարվա ազատազրկման դատապարտեցին

Սալվադորի Հանրապետության օրենսդրությունը միշտ է քննադատությունների երթարկվել՝ աբորտին ոչ տարածված և անսովոր իրավական կարգավորում տալու համար։
Օրեր առաջ Սալվադորի դատարանում 19-ամյա Էվելին Բեատրից Հերնանդեսը 30 տարվա ազատազրկման է դատապարտվել։ Իսկ ո՞րն է նրա հանցագործությունը․ ըստ դատավորի՝ աղջիկը դիտավորյալ հատուկ խնամքի չի արժանացրել իր նորածնին, ինչի արդյունքում երեխան մահացել է։ 2016 թվականի ապրիլին ծնված երեխան բռնաբարության արդյունք էր։ Էվելինը երեխային ծննդաբերել էր զուգարանի մեջ։
Դատախազը պնդում էր, որ Հերնանդեսը չի ցանկացել երեխա ունենալ, դրա համար էլ պտղին անուշադրության է մատնել։ Այն փաստը, որ այդ ժամանակ 18 տարեկան աղջիկը պտղին զուգարանի մեջ է ծննդաբերել, ամրապնդեց դատախազի կասկածները, որ նա դիտավորյալ է սպանել երեխային։
Սակայն Էվելինի փաստաբանի պատմությունն այլ է։ Նա պատմել է, որ իր վստահորդը բազմիցս բռնաբարությունների զոհ է դարձել և չի իմացել իր հղիության մասին մինչև այն պահը, երբ ծննդաբերել է։
Որովայնի շրջանում պարբերաբար ցավեր, ինչպես նաև հաճախ ուշաթափություններ ունենալու պատճառով նրա մայրն իրեն տարել է հիվանդանոց։ Հենց հիվանդանոցի զուգարանում էլ աղջիկը պատահմամբ ծննդաբերել է։ Բժիշկներին չի հաջողվել պարզել՝ երեխան մահացել է նրա արգանդում, թե լույս աշխարհ գալուց հետո։ Անկախ այդ փաստից՝ նրանք հաղորդում են ներկայացրել ոստիկանություն։
Դատավորը հավատարժան էր համարել դատախազի պնդումներն ու նաև ավելացրել, որ 19-ամյա աղջիկը չէր կարող միայնակ գործել, ուստի նրա մորը ևս ներգրավեցին որպես կասկածյալ։
Սալվադորի՝ 1998 թվականին ընդունված համապատասխան օրենքի համաձայն՝ աբորտը համարվում է քրեական հանցագործություն։ Մի քանի այլ երկրների հետ միասին Սալվադորի Հանրապետությունում արգելում է աբորտը՝ անկախ հանգամանքներից՝ անգամ այն դեպքում, երբ կնոջ կյանքին վտանգ է սպառնում։
Սա նշանակում է, որ Հերնանդեսը մեղավոր է, չնայած պտուղը բռնաբարության արդյունք էր։ Որպես պատիժ կիրառվում է 8-ից մինչև 40 տարի ազատազրկում՝ կախված, թե դատախազն ինչպես հանդես կգա դատարանում։
Հերնանդեսի փաստաբանը նշել է, որ պատրաստվում են բողոքարկել դատավճիռը։
Ակտիվիստները նշում են, որ հաճախ երիտասարդ աղջիկները չեն ունենում բավարար միջոցներ՝ փաստաբան վարձելու և իրենց իրավունքները պաշտպանելու համար։ Իսկ, օրինակ, հարուստները մեկնում են Սալվադորից այլ երկիր, աբորտ անում, ապա վերադառնում իրենց երկիր՝ խուսափելով քրեական պատասխանատվությունից։
2000 թվականից մինչև 2014 թվականը Սալվադորի Հանրապետությունում առնվազն 147 կին է ազատազրկման ենթարկվել՝ իրենց արգանդում գտնվող պտղին հեռացնելու համար։
