Դատախազությունը պետք է իրավապաշտպանի դեր ստանձնի՝ առաջնահերթությունը տալով իրավունքի գերակայությանը. Կոստանյան

Հայաստանի Հանրապետության դատախազությունը պետք է իրավապաշտպանի դեր ստանձնի, ինչը էականորեն կբարձրացնի այդ մարմնի նկատմամբ վստահությունը: Ազգային ժողովում ՀՀ գլխավոր դատախազության 2016թ. գործունեության մասին հաղորդման քննարկման ժամանակ այս մասին ասաց ԱԺ ՀՀԿ խմբակցության պատգամավոր, նախկին գլխավոր դատախազ Գևորգ Կոստանյանը: «Հանրապետության նախագահն էլ հայտարարել է, որ դատախազությունը պետք է ունենա իրավապաշտպան դեր: Եթե նախկինում մենք խոսում էինք օրենքի գերակայության սկզբունքից, ապա հիմա մենք օրենքի գերակայությունից անցել ենք իրավունքի գերակայության, սա նշանակում է, որ եթե օրենքը գործում է, բայց բովանդակային առումով հակասում է մարդու իրավունքին, ապա առաջնահերթությունը պետք է տրվի իրավունքին: Դատախազությունը միշտ ունեցել է պատժիչ ընկալում հասարակության մեջ: Այո, նախագահը ճիշտ ուղղություն տվեց. ցանկացած մեղադրյալ, ամբաստանյալ պետք է այնքան վստահ լինի, որ դատախազն օրինականության երաշխավորն է, որ փաստաբանի կարիք էլ չունենա: Դատախազը պետք է ստանձնի օրինականության երաշխավորի դերը»,- ասաց Կոստանյանը՝ հավելելով, որ ՀՀԿ-ն ավելի պահանջատեր է գլխավոր դատախազից, քան ընդդիմադիրները:

Գևորգ Կոստանյանը վստահություն հայտնեց, որ վերը նշված մեխանիզմի կիրառումը ՀՀ-ում կբարձրացնի դատախազության նկատմամբ հանրային վստահության մակարդակը:

Կոստանյանն անդրադարձավ նաև կալանքների խնդրին՝ նշելով, որ այդտեղ ևս լուրջ խնդիրներ կան, որոնք լուծման կարիք ունեն.  «Խոսքը կալանքների քանակներին ու համընդհանուր բնույթի մասին չէ, դա պետք է լինի մաքսիմալ հիմնավորված: Ամեն անգամ կալանավորելիս՝ նախաքննության մարմինը, դատարանը պետք է հիմնավորեն այն հիմքերը, որոնք առկայության պարագայում անձը կալանավորվում է»:
