«Փաստ» օրաթերթը գրում է.

Ինչպես հայտնի է, մոտ երկու շաբաթ առաջ Գլխավոր դատախազությունը մերժեց «Ելք» խմբակցության միջնորդությունը՝ Անդրիաս Ղուկասյանին կալանքից ազատ արձակելու վերաբերյալ:

Մերժման պատասխանում նշված էր, թե դատական ակտերում իրավացիորեն արձանագրվել են կալանավորման կիրառման պայմանների և հիմքերի առկայությունը, վարույթն իրականացնող մարմնի կողմից գործի քննության պատշաճ ընթացքն ապահովելու հանգամանքը: Բացի այդ կիրառված կալանավորումն այլընտրանքային խափանման միջոց գրավով փոխարինելն անթույլատրելի է՝ հաշվի առնելով գործի քննության ընթացքում մեղադրյալի կողմից ոչ իրավաչափ վարքագիծ դրսևորելու բարձր հավանականությունը:

Սրա հետ կապված «Փաստը» զրուցել է «Ելք» խմբակցության պատգամավոր Մանե Թանդիլյանի հետ՝ պարզելու դաշինքի հետագա քայլերը` կապված Անդրիաս Ղուկասյանի խափանման միջոցը փոխելու հետ:

– Նախևառաջ նման պատասխանից հետո ի՞նչ հետևություն է անելու «Ելք» դաշինքը, և արդյոք Դուք կանխատեսո՞ւմ էիք նման պատասխան:

– Պատասխանն, ըստ էության, չի բավարարում մեզ, քանի որ այդ հիմնավորումը անհեթեթ է: Հիմնավորումը, թե ձեռք են բերվել բավարար տվյալներ, որ նրան անազատության մեջ չպահելը բավարար չէ նրա ոչ իրավաչափ վարքագիծը կանխելու համար: Այս հիմնավորումը միշտ կարելի է բերել յուրաքանչյուր դեպքի համար: Այն խիստ սուբյեկտիվ և կամայական դատողություն է: Մինչդեռ ՄԻԵԴ–ը այլ ուղեծիր է նախանշում կալանքը` որպես խափանման միջոց ընտրելու համար: Պետք է հստակ ապացուցել, որ ազատության մեջ գտնվողը կխուսափի կամ կխոչընդոտի դատավարությանը: Սակայն այս կամայական դատողությունը դեռևս բավարար հիմք չէ նման ծայրահեղ խափանման միջոց կիրառելու համար: Եթե կան հիմնավոր փաստեր, անհրաժեշտ է դրանք ներկայացնել:

– Անդրիաս Ղուկասյանին ազատ արձակելու շանսերը արդյոք փո՞քր էին:

– Վերոգրյալից պարզ է դառնում, որ եթե կամայական դատողություն չկիրառվեր, ապա, հաշվի առնելով նաև այն հանգամանքը, որ Անդրիաս Ղուկասյանը պատրաստ էր պարտավորագիր ստորագրել, իսկ մեր խմբակցության պատգամավորները` երաշխավոր կանգնել, որ նա չի խուսափի և չի խոչընդոտի դատավարությանը, շանսերն, իհարկե, մեծ էին: Դրա համար էլ դիմել էինք, քանի որ տեսնում էինք, որ չբավարարելու հիմքեր չկան:

– Հետագա քայլեր Անդրիաս Ղուկասյանին օգնելու տեսանկյունից կա՞ն, թե այս մերժումից հետո այլևս ոչինչ հնարավոր չէ անել:

– Այս պահին ընթանում են գլխավոր դատախազի հաշվետվության Խորհրդարանական լսումներ Ազգային Ժողովում: Մենք շարունակում ենք հարցը պահել ուշադրության կենտրոնում նաև այստեղ: Թե ինչ իրավական այլ հնարավորություններ կան, կդժվարանամ պատասխանել, սակայն մենք օգտագործում ենք մեր մանդատները պաշտպան կանգնելու յուրաքանչյուր մարդու իրավունքներին, որքանով որ պատգամավորական մանդատը լիազորում է մեզ դա անելու:
