Աճպարարություն էր. 15-ամյա հանդբոլիստի մահվան մեջ մեղադրվողը դատապարվեց 7 տարվա ազատազրկման

Վերաքննիչ քրեական դատարանն այսօր՝ հուլիսի 18-ին, մասնակիորեն բավարարել է մեղադրող դատախազի վերաքննիչ բողոքն ու Վանաձորում 15-ամյա հանդբոլիստ Դավիթ Հովակիմյանի սպանության մեջ մեղադրվող Կարեն Կունգուրցեւին դատապարտել 7 տարվա ազատազրկման: NEWS.am-ի հետ զրույցում Կարեն Կոնգուրցեւի շահերի պաշտպան Արայիկ Պապիկյանը Վերաքննիչ դատարանի դատական ակտը որակեց որպես աճպարարություն:
«Վերաքննիչ դատարանն իր այս որոշմամբ փրկեց և՛ քննիչներին, և՛ բյուջեից դուրս եկող գումարները, որոնք պետք է հատուցեին իմ պաշտպանյալին ապօրինի կալանքի տակ պահելու համար, եւ նախաքննական մարմինը փրկվեց: Բացի այդ ազատվեցին իսկական մեղավորին գտնելու գլխացավանքից: Իմ պաշտպանյալը հովանավորներ չուներ, ինքը պետք է պատժվեր, չէ որ մամուլում էլ տեղեկություններ կար, որ սպանությունը կատարել է ԱԱԾ պաշտոնյայի որդի է: Վերաքննիչի որոշումը պատվեր էր»,-ասաց նա:
Փաստաբան Արայիկ Պապիկյանը նաեւ նշեց, որ վերաքննիչ դատարանը փոխել է իր պաշտպանյալին առաջադրված մեղադրանքը:
«Մեղադրող դատախազը բողոք էր բերել, որ Կարեն Կունգուրցեւին մեղավոր ճանաչեն ՀՀ քր. օր-ի 34-104 հոդ. 1-ին մասով՝ սպանության փորձ, սակայն, Վերաքննիչը փոխեց մեղադրանքը եւ իմ պաշտպանյալին մեղավոր ճանաչեց ՀՀ ՔՕ-ի 112-րդ 2-րդ մասի 14 կետով՝ դիտավորությամբ առողջությանը ծանր վնաս պատճառելը: 4 տարի անց սա ապտակ էր դատախազությանը, որը վստահ էր, որ տեղի ունեցածը սպանության փորձ է, այսինքն՝ դատախազությունը մոլորության մեջ է եղել»,-ասաց պաշտպանը:
Արայիկ Պապիկյանը նաեւ նշեց, որ Կարեն Կոնգուրցեւը կալանքի տակ է առնվել հենց դատական նիստերի դահլիճից: Նա վերջրես էր ամուսնացել, ունի 2 ամսական երեխա:
Հիշեցնենք, որ Լոռու մարզի առաջին ատյանի դատարանը հանցակազմի բացակայության հիմքով արդարացրել էր Կարեն Կունգուրցեւին եւ ազատ արձակել դատական նիստերի դահլիճից:
