Արդարադատության ակադեմիայում սովորող քննիչների թեկնածուները նույնպես կրթաթոշակ կստանան

Իրավական ակտերի նախագծերի հրապարակման միասնական կայքում շրջանառության են դրվել «Քննչական կոմիտեի մասին» օրենքում լրացում կատարելու և «Արդարադատության ակադեմիայի մասին» օրենքում փոփոխություն կատարելու մասին օրենքների նախագծերը։
 
Օրենքների նախագծերով առաջարկվում է Արդարադատության ակադեմիայում ուսումնառության դասընթացներից և որակավորման քննություն հանձնելուց ազատել նաև հետաքննության մարմնի պետին և աշխատակիցներին, ովքեր իրենց մասնագիտական գործունեության ընթացքում առավելապես իրականացնում են քննչական գործողություններ: Ասվում է, որ այլ պաշտոնների համատեքստում նաև այս անձանց համար բացառության նախատեսումը կհանգեցնի չհիմնավորված տարբերակված մոտեցման վերացմանը: Միևնույն ժամանակ առաջարկվում է քննիչների թեկանածությունների ցուցակում ընդգրկված անձանց համար նախատեսել մասնագիտական պատրաստման ընթացքում կրթաթոշակ ստանալու հնարավորություն՝ հավասար պայմաններ ստեղծելով Արդարադատության ակադեմիայում ուսումնառող այլ ունկնդիրների հետ:
 
Ըստ նախագծի՝ Արդարադատության ակադեմիայի գործունեության նպատակներից են` դատավորների, դատախազների, քննիչների թեկնածությունների ցուցակում ընդգրկված անձանց մոտ դատավորի, դատախազի, քննիչի պաշտոն զբաղեցնելու համար անհրաժեշտ հմտությունների ձևավորումը, մասնագիտական գիտելիքների ընդլայնումը: Դատավորների և դատախազների թեկնածությունների ցուցակում ընդգրկված անձինք ակադեմիայում մասնագիտական պատրաստման ընթացքում ստանում են ընդհանուր իրավասության դատարանի դատավորի օգնականի վարձատրությանը համապատասխան կրթաթոշակ՝ 175 հազար 932 դրամ։ Մինչդեռ, քննիչների թեկնածությունների ցուցակում ընդգրկված անձանց համար մասնագիտական պատրաստման ընթացքում կրթաթոշակ ստանալու վերաբերյալ դրույթ նախատեսված չէ:
 
Ըստ նախագծի՝ 2017 թ.–ին ակադեմիայում որպես ունկնդիր ուսուցանել են քննիչների թեկնածությունների ցուցակում ընդգրկված 50, դատախազների՝ 21 և դատավորների՝ 19 ունկնդիր։ 2018 թ.–ին նախատեսվում է քննիչների թեկնածությունների ցուցակում 40 ունկնդրի համար կրթաթոշակի տրամադրում: 2017 թ.–ին ակադեմիայում ուսումնառություն անցնող դատավորների, դատախազների թեկնածությունների ցուցակում ընդգրկված՝ 19 և 21 ունկնդիրների համար պետական բյուջեից ընդհանուր առմամբ հատկացվում է 26 միլիոն 741 հազար և 29 միլիոն 556 հազար 576 դրամին համարժեք կրթաթոշակ։
 
Նախագծով առաջարկվող փոփոխության արդյունքում նախատեսվում է 2018 թ.–ի պետական բյուջեի միջոցների հաշվին կրթաթոշակ տրամադրել ոչ միայն դատավորների, դատախազների թեկնածությունների ցուցակում ընդգրկված, այլ նաև քննիչների թեկնածությունների ցուցակում ընդգրկված ունկնդիրներին՝ 1 ունկնդրի համար 111 հազար 115 դրամին համարժեք։ Այս պարագայում քննիչների, դատավորների, դատախազների ունկնդիրների թվի միջին թվաբանական հաշվարկի արդյունքում 2018 թ. պետական բյուջեի ծախսը տարվա կտրվածքով կկազմի քննիչների նախատեսվող 40 ունկնդրի համար՝ 35 միլիոն 556 հազար, դատավորների 19 ունկնդրի համար՝ 16 միլիոն 889 հազար, իսկ դատախազների 21 ունկնդրի համար՝ 18 միլիոն 667 հազար դրամ:
 
Բացի այդ ներկայումս Քննչական կոմիտեում առկա է քննիչի 50 թափուր հաստիք, ինչը պայմանավորված է նրանով, որ քննիչների թեկնածությունների ցուցակում ընդգրկված ունկնդիրներն 8 ամիս առանց եկամտի աղբյուրի մնալու պայմաններում չեն ցանկանում ուսումնառություն անցնել։
