Հովհաննիսյանը հանցագործության մասին հաղորդում տվող անձանց բարդություններից պաշտպանելու նախագիծ է դրել շրջանառության մեջ

ՀՀ Ազգային ժողովի նախագահի տեղակալ Արփինե Հովհաննիսյանը շրջանառության մեջ է դրել «Քրեական դատավարության օրենսգրքում լրացում կատարելու մասին» Հայաստանի Հանրապետության օրենքի նախագիծը: «Արմենպրես»-ի հաղորդմամբ` նախագծի նպատակն է պաշտպանել հանցագործության մասին հաղորդում տվող անձանց հնարավոր բարդություններից:
«Բազմաթիվ են այն դեպքերը, երբ առանց հանցագործության վերաբերյալ հաղորդման մեջ նշված հանգամանքները հերքելու կամ հաստատելու, հաղորդում տված անձի նկատմամբ հարուցվում է սուտ մատնության վերաբերյալ քրեական գործ: Այսինքն, անձը հաղորդում ներկայացնելիս ի սկզբանե հայտնվում է սուտ մատնության գործով մեղադրյալի կարգավիճակում, այն դեպքում, երբ դեռևս հստակ չէ այն քրեական գործի ճակատագիրը, որի մասին այդ անձը հայտնել է: Նախագծով առաջարկվում է սահմանել, որ անձի նկատմամբ սուտ մատնության դեպքով քրեական գործ կարող է հարուցվել միայն այն դեպքերում, երբ վարույթն իրականացնող մարմինը պատշաճ և հիմնավորված կերպով հերքել է հաղորդման մեջ նշված հանցագործության փաստական հանգամանքները, ինչը կբացառի այն մտավախությանը, որ հանցագործության հաղորդում տված անձը կարող է հեշտությամբ հայտնվել սուտ մատնության գործով մեղադրյալի կարգավիճակում»,-նշել է Արփինե Հովհաննիսյանը:
ՀՀ Ազգային ժողովի նախագահի տեղակալը առաջարկում է ՀՀ քրեական դատավարության օրենսգրքը լրացնել հետևյալ հոդվածով.
«Սուտ մատնության վերաբերյալ քրեական գործ հարուցելու հարցը քրեական գործ հարուցելու իրավասություն ունեցող մարմինը կարող է քննարկել, եթե հանցագործության վերաբերյալ հաղորդման քննարկման արդյունքում որոշում է կայացվել ՀՀ քրեական դատավարության օրենսգրքի 35-րդ հոդվածի 1-ին մասի 1-ին եւ 2-րդ կետերով քրեական գործի հարուցումը մերժելու, հարուցված քրեական գործի վարույթը կարճելու, քրեական հետապնդումը դադարեցնելու, քրեական հետապնդում չիրականացնելու մասին կամ կայացվել է արդարացման դատավճիռ»:
