Փաստաբանների պալատում քննարկել են ԱՄն-ում փաստաբանների աշխատանքի առանձնահատկությունները

ՀՀ փաստաբանների պալատը հուլիսի 28-ին հյուրընկալել էր ԱՄՆ-ի Հայ իրավաբանների միության խորհրդի անդամ, նույն միության հայերի իրավունքների պաշտպանության կոմիտեի համաատենապետ, փաստաբան Գարո Ղազարյանին: ՀՀ փաստաբանների պալատի մամուլի կենտրոնից «Արմենպրես»-ին տեղեկացրին, որ փաստաբանների հետ հանդիպման հիմնական ուղղվածությունը «Փաստաբանի մասնագիտությունը և վարքագիծը ԱՄՆ-ում» թեմայով քննարկումն էր:
Գարո Ղազարյանը, ողջունելով գործընկերներին, նշել է, որ կարևոր է փաստաբանի մասնագիտությունը հատկապես այն երկրներում, որտեղ ժողովրդավարական արժեքները նոր են սերմանվում: Այս
Նա ներկայացրել է Միացյալ Նահանգներում փաստաբանների աշխատանքի առանձնահատկությունները, մասնագիտական էթիկայի կանոնները: Մասնագիտական վարքագծի կանոնների վերաբերյալ փաստաբանների մի շարք հարցերին անդրադառնալով՝ Գարո Ղազարյանն ընդհանրական մեկնաբանություններ է արել՝ մասնավորապես նշելով, որ Վարքագծի կանոնները տարածվում են փաստաբանի մասնագիտական, հանրային, իսկ որոշ դեպքերում՝ նաև անձնական կյանքի վրա: Ըստ Ղազարյանի՝ Միացյալ Նահանգներում փաստաբանը համարվում է արդարադատության սպա, որը արդարադատության իրականացման կարևոր օղակն է և հաշվետու է հանրությանն իր գործողությունների համար:
ԱՄՆ փաստաբանը նշել է, որ հետևում է Հայաստանում հանրային հնչեղություն ունեցող դատավարություններին՝ կարևորելով փաստաբանների աշխատանքը յուրաքանչյուր դատավարությունում: Այս համատեքստում քննարկվել են նաև վերջին օրերին փաստաբանությանը հուզող զննության առնչվող հարցեր:
Անդրադարձ է եղել նաև վստահորդի իրավունքներին: Գարո Ղազարյանը նշել է, որ իրենց մոտ մեղադրյալն ունի երեք հիմնական իրավունքներ՝ 1. ընդունել կամ չընդունել մեղադրանքը, 2. հայտնել դիրքորոշում իր գործը դատարանի կամ երդվյալ ատենակալների կողմից քննվելու վերաբերյալ, 3. ցուցմունք տալ կամ լռել: Գարո Ղազարյանը նշել է, որ ԱՄՆ-ում փաստաբանը իրավունք չունի կատարելու իր վստահորդի ոչ օրինական ցուցումները:
Քննարկվել են նաև երկուստեք հետաքրքրություն ներկայացնող մասնագիտական այլ հարցեր:
