Պաշտոնեական դիրքը չարաշահած ոստիկանը կալանավորվել է

ՀՀ հատուկ քննչական ծառայությունում ՀՀ քրեական օրենսգրքի 308-րդ հոդվածի 1-ին մասով քննվող քրեական գործով իրականացված նախաքննության ընթացքում ծառայության քննիչի կողմից որոշում է կայացվել ՀՀ ոստիկանության Գեղարքունիքի մարզային վարչության հերթապահ մասի ՁՊՎ ոստիկան Ա. Մ.-ին որպես մեղադրյալ ներգրավելու մասին:
Ինչպես «Արմենպրես»-ին տեղեկացրին ՀՀ ՀՔԾ լրատվական ծառայությունից, նախաքննությամբ պարզվել է, որ Ա. Մ.-ն, 2017 թվականի հուլիսի 27-ին հերթապահել է ոստիկանության Գեղարքունիքի մարզային վարչության Մարտունու բաժնի ՁՊՎ-ում, որի խցում այդ օրը պահվել են ՀՀ ԱՆ «Նուբարաշեն» ՔԿՀ կալանավոր Ա. Ա.-ն և ՀՀ ԱՆ «Հրազդան» ՔԿՀ կալանավոր Ռ. Ա.-ն, ովքեր Մարտունի քաղաք էին տեղափոխվել իրենց վերաբերյալ քննվող քրեական գործերով նշանակված դատական նիստերին մասնակցելու համար: Նույն օրը երեկոյան կալանավորներից Ռ. Ա.-ն կանչել է հերթապահող ոստիկան Ա. Մ.-ին և խնդրել իրեն ուղեկցել ՁՊՎ-ի սանհանգույց: Քննությամբ ձեռք բերված բավարար ապացույցներով հիմնավորվել է, որ Ա. Մ.-ն, խախտելով ՀՀ կառավարության որոշմամբ հաստատված ՁՊՎ ներքին կանոնակարգի պահանջները, առանց ՁՊՎ պետի կամ նրա օգնականի մասնակցության բացել է դեպի խուց տանող մետաղյա ճաղավանդակներով երկու դռները, ապա` խցի դուռը, իսկ կալանավորին սանհանգույց ուղեկցելիս բոլոր երեք դռները թողել է բաց վիճակում: Այնուհետև, կալանավորին խուց վերադարձնելու փոխարեն, նրա հետ գնացել է սնունդ ընդունելու համար հատկացված սենյակ: Այդ ընթացքում խցում պահվող մյուս կալանավոր Ա. Ա.-ն, օգտվելով տևական ժամանակ առանց հսկողության մնալու հանգամանքից, կարողացել է չկողպված դռներով հասնել ոստիկանի աշխատասենյակ, որտեղից վերցնելով դեպի տուգանային հրապարակ տանող ելքի դռան բանալիները` ՁՊՎ-ից դիմել է փախուստի:
Այսպիսով, Ա. Մ.-ն պաշտոնեական դիրքն օգտագործել է ծառայության շահերին հակառակ, չի կատարել իր գործառութային պարտականությունները, այն է` մշտական հսկողություն չի սահմանել ձերբակալվածների և կալանավորվածների նկատմամբ, խստիվ չի պահպանել ՁՊՎ-ում ընդունված ներքին կանոնակարգը, որի համար նրան մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 308-րդ հոդվածի 1-ին մասով: Ա. Մ.-ն կալանավորվել է: Նախաքննությունը շարունակվում է:
Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
