Սահմանադրական դատարանը որոշում կայացրեց հօգուտ լրագրողների. քրեական գործերը ենթակա են վերանայման

Հայաստանի Հանրապետության սահմանադրական դատարանը ելնելով գործի քննության արդյունքներից և ղեկավարվելով Հայաստանի Հանրապետության Սահմանադրության 100-րդ հոդվածի 1-ին կետով, 102-րդ հոդվածով, «Սահմանադրական դատարանի մասին» Հայաստանի Հանրապետության օրենքի 13, 14, և 15-րդ հոդվածներով, որոշեց.
««Զանգվածային լրատվության մասին» ՀՀ օրենքի 5-րդ հոդվածի 2-րդ մասը համապատասխանում է ՀՀ Սահմանադրությանը` սույն որոշմամբ Սահմանադրական դատարանի կողմից բացահայտված սահմանադրաիրավական բովանդակության շրջանակներում: «Զանգվածային լրատվության մասին» ՀՀ օրենքի 5-րդ հոդվածի երկրորդ մասի սահմանադրաիրավական բովանդակությունը հանգում է նրան, որ իրավունքի գերակայությամբ առաջնորդվող ժողովրդավարական պետությունում իրավական որոշակիության և իրավունքների սահմանափակման համաչափության սկզբունքներից ելնելով, տեղեկատվության աղբյուÖ �ի բացահայտման օրինական շահը գերակա կարող է ճանաչվել այն չբացահայտելու հանրային շահից այն դեպքերում, երբ աղբյուրի բացահայտումն անհրաժեշտ է անձի կյանքի պաշտպանության, ծանր, առանձնապես ծանր հանցագործությունները կանխելու և, առանձնապես ծանր հանցագործությունների մեջ մեղադրվող անձի դատական պաշտպանությունը ապահովելու համար: Այդ իրավապայմաններից առնվազն մեկի առկայությունը միայն կարող է հիմք հանդիսանալ օրենքով սահմանված կարգով իրականացնել տեղեկատվության աղբյուրի բացահայտումը:
«ՀՀ քրեական դատավարության օրենսգրքի 14-րդ հոդվածի երկրորդ մասը, 41-րդ հոդվածի 2-րդ մասի 1-ին կետը և 279-րդ հոդվածը համապատասխանում են Հայաստանի Հանրապետության Սահմանանդրությանը, սույն որոշման մեջ Սահմանադրական դատարանի կողմից արձանագրված իրավակարգավորումների շրջանակներում:
«Սահմանադրական դատարանի մասին» Հայաստանի Հանրապետության օրենքի 69-րդ հոդվածի 12-րդ մասի, ինչպես նաև ՀՀ քրեական դատավարության օրենսգրքի 426.4-րդ հոդվածի հիման վրա դիմողների նկատմամբ կայացված վերջնական դատական ակտերը նոր հանգամանքների հիմքով, օրենքով սահմանված կարգով ենթակա են վերանայման, քանի որ վեճի առարկա դրույթները դիմողների նկատմամբ կիրառվել են այլ մեկնաբանությամբ:
Հայաստանի Հանրապետության Սահմանադրության 102-րդ հոդվածի երկրորդ մասի համաձայն սույն որոշումը վերջնական է և ուժի մեջ է մտնում հրապարակման պահից»,-նշված է ՀՀ Սահմանադրական դատարանի որոշման մեջ։
