ՀՀ Դատախազությունում կայացել է կոլեգիայի ընդլայնված նիստ

 ՀՀ Դատախազության կոլեգիայի օգոստոսի 4-ին կայացած ընդլայնված նիստում,որը նախագահել է ՀՀ գլխավոր դատախազ Արթուր Դավթյանը քննարկվել են խափանման միջոց կալանավորման օրինականության և հիմնավորվածության, հակընդդեմ հարցման իրավունքի ապահովման գործնական խնդիրները:

Ինչպես «Արմենպրես»-ին տեղեկացրին ՀՀ դատախազության հանրային կապերի բաժնից, հուլիսի 3-ին դատախազության օրվան նվիրված հանդիսավոր նիստում Հանրապետության Նախագահ Սերժ Սարգսյանի կողմից իրավապահ գործունեության ընթացքում նշված հիմնարար կոնվենցիոնալ իրավունքների ապահովման առանձնահատուկ կարևորությունն ընդգծելուց հետո ՀՀ գլխավոր դատախազի հանձնարարությամբ ստեղծված աշխատանքային խմբերի կողմից նախորդ մեկ ամսվա ընթացքում ուսումնասիրվել և վեր են հանվել այս ոլորտում առկա գործնական խնդիրները և առաջարկվել հստակ լուծումներ: Ուսումնասիրության շրջանակներում վերլուծվել են ազատության և անձնական անձեռնմխելիության իրավունքի վերաբերյալ ՄԻԵԴ ձևավորած նախադեպային իրավունքը և ներպետական իրավական կարգավորումները:

Հատուկ ուշադրության և վերլուծության են արժանացել Հայաստանի դեմ գործերով ՄԻԵԴ վճիռներում արձանագրված իրավիճակներն ու խախտումները՝ փաստելով, որ դրանք հետևանք են նաև կալանավորման հիմքերի պարզմանն ու հիմնավորմանն ուղղված բավարար միջոցներ չձեռնարկելու, ինչպես նաև նման փաստական տվյալների տիրապետելու դեպքում, անհետևողականության կամ չիմացության պատճառով խափանման միջոց կալանավորում կիրառելու բավարար հիմքերի ակնհայտ առկայության պայմաններում քննիչի կողմից դրանք միջնորդության մեջ չարտացոլելու և չվերլուծելու: Մանրամասն վերլուծվել են Կոնվենցիայի 6-րդ հոդվածով երաշխավորված՝ իր դեմ ցուցմունք տված անձանց հակընդդեմ հարցման ենթարկելու իրավունքի՝ եվրոպական դատարանի կողմից Հայաստանի դեմ կայացված վճռներում արձանագրված խախտումների պատճառները:

Հատուկ կարևորվել է վկաներին դատարան ներկայացնելու ուղղությամբ պատշաճ ջանասիրություն ցուցաբերելու և որպես նշված իրավունքի ապահովմանն ուղղված լրացուցիչ երաշխիք՝ դատավարության ավելի վաղ փուլերում դրա իրացման անհրաժեշտությունը: ՀՀ գլխավոր դատախազ Արթուր Դավթյանն առանձնահատուկ կարևորել է վեր հանված խնդիրների և ՄԻԵԴ ձևավորած չափանիշների համադրությամբ սահմանված կառուցակարգերի անշեղ պահպանման անհրաժեշտությունը՝ արձանագրելով դրանց խախտման դեպքում իրավասու պաշտոնատար անձանց պատասխանատվության անխուսափելիությունը: Կոլեգիայի նիստին մասնակցել և քննարկված հարցերի շուրջ դիտարկումներով հանդես են եկել նաև ՀՀ արդարադատության նախարարի տեղակալը, ՀՀ ոստիկանության, Քննչական կոմիտեի, Հատուկ քննչական ծառայության, Ազգային անվտանգության ծառայության և Պետական եկամուտների կոմիտեի ներկայացուցիչները: ՀՀ դատախազության կողմից կատարված ուսումնասիրության արդյունքում կազմված ուղեցույցները կուղարկվեն քննություն իրականացնող համապատասխան մարմիններ և կտեղադրվեն ՀՀ դատախազության պաշտոնական կայքում:
