Քրեական արդարադատության մասնագետ, հոգեբան Արշակ Գասպարյանը Lragir.am-ին տված հարցազրույցում խոսում է հանցագործությունը ծնող պատճառների ու այն փուլերի մասին, որոնք անցնում է մարդը նախքան հանցագործությունը կատարելը:

Մասնավորապես, ուշադրության է արժանի երկու հանգամանք՝ մանկուց մարդու մոտ դիմացինի հանդեպ վերաբերմունքը՝ «դիմացինի գույքը, կյանքն ու առողջությունը կարևոր չեն, կարևոր եմ միայն ես, կարևոր են իմ զգացողությունները, ստամոքսը, հաստ աղին և մնացյալը: Երբ մարդուն հասցնում ես այդ վիճակին, որ ինքը կենսաբանական պահանջմունքից ավելի չի մտածում, իր համար դիմացինի կյանքը, առողջությունը, ձեռքբերումները դառնում են զրոյական»:

Հաջորդ հանգամանքը հոգեբանը ձեւակերպում է հետեւյալ կերպ. «Երբ որ մարդուն սովորեցնում են, որ տղամարդը ընտանիքի դրամապանակն է, սա դիրքորոշում է: Եվ եթե հանկարծ այդ դրամապանակի գումարն սկսում է պակասել, տղամարդն իր իսկ աչքերում չընկնելու և իր պատկերացումները չխաթարելու համար, ունենալով իրավիճակ, որ դրամը վերջացել է, ունենում է ինչ-որ վարքի ձև: Այդ վարքի ձևը կարող է լինել բռնությունը՝ սկսած բակում ուղղակի գոռգոռալուց, նյարդայնանալուց, վերջացրած ինչ-որ գործողություններ կատարելուց, որը կարող է հանգեցնել նաև հանցագործության»:

Վերջին շրջանի աղմկոտ իրադարձություններին իրավապահները պատասխանեցին «կենցաղային հողով»՝ առատորեն սփռվող պարզաբանումներով ու արտահոսքերով ընդգծելով այդ իրադարձությունների կենցաղային բնույթը: Իշխանությունն այդպիսով թերեւս ցանկանում էր ցույց տալ, թե դա իր պատասխանատվության տիրույթում չէ: 

Այնինչ, արժեքային համակարգը, միջավայրն իր բարքերով ու պատկերացումներով մեծ հաշվով ուղիղ առնչություն ունեն իշխանության գործունեության հետ: Խնդիրն այն է, թե այդ իշխանությունն ինչ բարքեր ու հարաբերություններ է խրախուսում, որոնք են նրա օրոք կյանքի տարբեր ոլորտներում հաջողության հասնելու միջոցները, ինչ չափորոշիչներ են գործում:

Այս խնդիրները իշխանության տիրույթում են, քանի որ նա է տիրապետում հաղորդակցության ամենամեծ միջոցներին: Ավելորդ է ասել, որ հայկական իշխանությունն ինքը քրեածին է, քանի որ նրա հիմքը կրիմինալն է: Նման համակարգերում արդարադատություն որպես այդպիսին չի գործում կամ գործում է ընտրովի, իրավապահ համակարգն ավելի շատ գործում է պանյատների, քան օրենքի շրջանակներում, ինչը մարդուն հասցնում է սեփական «արդարադատության» հաստատման գիտակցությանը:

Հայաստանում այս իրավիճակը երեւում է հասել ու անցել է սահմանագիծը: «Կենցաղային հողի» վրա կատարվողը դառնում է կյանքի նորմ, որն ինչ որ պահից անցնելու է այլ մակարդակի՝ ունենալով արդեն սեփական օրենքներն ու կանոնները եւ ի վերջո կանգնելու է գործող իրավապահ համակարգի դեմ:

Նման օրինակներ աշխարհում կան, որոնք ի վերջո կամ հասցրել են հանրային-պետական եւ արժեհամակարգային վերջնական ու անշրջելի դեգրադացիայի, կամ հաստատվել է օրենքը՝ երկու զուգահեռ «արդարադատությունների» բախման ու սերտաճման արդյունքում:

Հայաստանում երկրորդ ճանապարհն անհնար է թվում:
