Դատավորների կողմից առանձնապես խոշոր չափերով կաշառք ստանալու դեպքի առթիվ ՀԾՔ-ում հարուցվել է քրեական գործ

ՀՀ հատուկ քննչական ծառայությունում քրեական գործ է հարուցվել դատավորների կողմից առանձնապես խոշոր չափերով կաշառք ստանալու և կաշառքի միջնորդության դեպքերի առթիվ:

Ինչպես «Արմենպրես»-ին տեղեկացրին ՀՀ հատուկ քննչական ծառայությունից, Գեղարքունիքի մարզի ընդհանուր իրավասության դատարանի նախագահի ու նույն դատարանի դատավորի վերաբերյալ ծառայությունում քննվող քրեական գործով վկա, Մարտունի քաղաքի բնակիչ Մ. Ա.-ն հաղորդում է տվել, որ դատական կարգով համապատասխան ընկերության տարածքի մի մասը սեփականության իրավունքով ձեռք բերելու համար 2012թ.-ին դիմել է Գեղարքունիքի մարզի ընդհանուր իրավասության դատարանի նախագահ Ա. Պետրոսյանին: Դրա համար Ա. Պետրոսյանը նույն մարզի ընդհանուր իրավասության դատարանի դատավորի օգնականի միջոցով իրենից պահանջել է 6.000 ԱՄՆ դոլարի չափով կաշառք, որի մի մասն ինքը փոխանցել է որպես միջնորդ հանդես եկած դատավորի օգնականի, իսկ մյուս մասը` դատարանի նախագահի վարորդի միջոցով:

Կաշառքի գումարը փոխանցելուց հետո Մ. Ա.-ն տեղեկացել է, որ նշված ընկերության տարածքն այլ անձանց կողմից կեղծ փաստաթղթերով օրինականացնելուց հետո վաճառվել է 80.000 ԱՄՆ դոլարով, որից 30.000 ԱՄՆ դոլարը որպես կաշառք տրվել է վերը նշված դատարանի նախագահին: Ուստի Մ. Ա.-ն 2014թ.-ին միջնորդից ետ է վերցրել իր կողմից որպես կաշառք տրված 6.000 ԱՄՆ դոլար գումարը:

Մ. Ա.-ն հայտնել է նաև, որ ՀՀ վերաքննիչ քաղաքացիական դատարանում հօգուտ իրեն դատական ակտ կայացնելու համար տարբեր ժամանակահատվածներում ընդհանուր առմամբ 13.000 ԱՄՆ դոլար կաշառք է տվել Երևանի վարչական շրջաններից մեկի ընդհանուր իրավասության դատարանի դատավորին, սակայն,   քանի որ դատական ակտն ի վնաս իրեն է կայացվել, ուստի դատավորը ետ է վերադարձրել կաշառքի գումարի մի մասը, իսկ մնացած 8.000 ԱՄՆ դոլարը վերադարձնելու վերաբերյալ ստացական է տվել:

Այսպիսով, դատավորների կողմից առանձնապես խոշոր չափերով կաշառք ստանալու և կաշառքի միջնորդության դեպքերի առթիվ ՀՀ հատուկ քննչական ծառայությունում հարուցվել է քրեական գործ` ՀՀ քրեական օրենսգրքի 311-րդ հոդվածի 4-րդ մասի 2-րդ և 3-րդ կետերով և 313-րդ հոդվածի 1-ին մասով:

Կատարվում է նախաքննություն:

Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
