ՀՀ քննչական կոմիտեն ավարտել է թմրանյութերի ապօրինի շրջանառության դեպքով քրգործի նախաքննությունը

ՀՀ քննչական կոմիտեի Երևան քաղաքի քննչական վարչության Շենգավիթ վարչական շրջանի քննչական բաժնում ավարտվել է թմրանյութերի ապօրինի շրջանառության դեպքի առթիվ հարուցված քրեական գործի նախաքննությունը: Ձեռք բերված ապացույցների հիման վրա մեղադրանք է առաջադրվել Երևանի 34-ամյա բնակչին:
Ինչպես «Արմենպրես»-ին տեղեկացրին ՀՀ քննչական կոմիտեից, քրեական գործի նախաքննությամբ պարզվել է, որ Երևան քաղաքի 34-ամյա բնակիչը, ով հետաքրքրություն է ունեցել թմրամիջոցների նկատմամբ, 2015 թվականին իր ընկերոջ միջոցով ծանոթացել է Ուկրաինայի Հանրապետության Օդեսա քաղաքում բնակվող հայազգի մի տղամարդու՝ Արթուրի հետ։ Վերջինս առաջարկել է Օդեսայից լավ թմրանյութ ուղարկել Երևան։ Ձեռք բերված պայմանավորվածության համաձայն՝ առաքված թմրամիջոցի մի մասը 34-ամյա տղամարդը պետք է թողներ Արթուրի մատնանշած վայրում, իսկ որոշ մասն էլ պահեր իր մոտ՝ անձնական օգտագործման համար։
Ձեռք բերված փաստական տվյալների համաձայն՝ տղամարդը 2017թ. հունիսի 1-ին Երևան քաղաքի Արշակունյաց պողոտայում գործող ուղևորափոխադրող ընկերությունից ստացել է փաթեթ, որտեղ կոշկի տուփում թաքցված է եղել իրացնելու նպատակով ծանոթի կողմից ուղարկված առանձնապես խոշոր չափերի՝ 34.83 գրամ «a-PVP» տեսակի թմրամիջոցը:
Ձեռք բերված բավարար ապացույցների համակցությամբ՝ Երևանի 34-ամյա բնակչին մեղադրանք է առաջադրվել՝ ՀՀ քրեական օրենսգրքի 38-266-րդ հոդվածի 3-րդ մասի 2-րդ կետով և 38-267.1 հոդվածի 4-րդ մասի 1-ին կետով: Նրա վերաբերյալ մասն անջատվել է առանձին վարույթ, և քրեական գործը՝ մեղադրական եզրակացությամբ, ուղարկվել նախաքննության օրինականության նկատմամբ հսկողություն իրականացնող դատախազին:
Անջատված մասով նախաքննությունը շարունակվում է՝ մաքսանենգ ճանապարհով թմրամիջոցի ապօրինի շրջանառությանը մասնակցություն ունեցած շրջանակը պարզելու ուղղությամբ։
Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարությանօրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
