Պաշտոնատար անձանց կողմից խոշտանգում կատարելու փաստերով հարուցվել են քրեական գործեր

ՀՀ հատուկ քննչական ծառայության քննիչի վարույթին հանձնված բազմադրվագ հանցագործությունների` բնակարանային գողությունների, զենքի գործադրմամբ ավազակային հարձակման, ինչպես նաև ապօրինի հրազեն կրելու փաստերով հարուցված քրեական գործի նախաքննության ընթացքում ի հայտ են եկել պաշտոնատար անձանց կողմից կատարված առերևույթ հանցագործությունների նոր հանգամանքներ, որոնց վերաբերյալ նախապատրաստված նյութերով հարուցվել են երեք քրեական գործեր:

Ինչպես տեղեկացրին ՀՀ հատուկ քննչական ծառայությունից, այսպես, վերը նշված բազմադրված հանցագործությունների վերաբերյալ քրեական գործով մեղադրյալներ, «Արմավիր» ՔԿՀ-ի կալանավորներ Հ. Ա.-ն, Լ. Ս.-ն և Վ. Շ.-ն հաղորդումներ են տվել ՀՀ ոստիկանության Արմավիրի բաժնի մի խումբ պաշտոնատար անձանց կողմից խոշտանգում կատարելու դեպքերի վերաբերյալ:

Հ. Ա.-ն հայտնել է, որ գողություն կատարելու կասկածանքով 18.07.2017թ.-ին բերման է ենթարկվել ոստիկանության Արմավիրի բաժին, որտեղ ոստիկանության մի խումբ աշխատակիցներ ծեծել են իրեն և բռնության գործադրմամբ խոստովանական ցուցմունք կորզել Մեծամոր քաղաքում իր կողմից կատարված բնակարանային գողության վերաբերյալ: Ըստ Հ. Ա.-ի` ոստիկանների կիրառած բռնությունների հետևանքով ինքը մարմնական վնասվածքներ է ստացել:

Բնակարանային գողությունների և ավազակային հարձակման գործով մյուս մեղադրյալ Լ. Ս.-ն ևս հայտնել է, որ ոստիկանության Արմավիրի բաժնում  18.07.2017թ.-ին ծեծի է ենթարկվել ոստիկանության մի խումբ  աշխատակիցների կողմից, ովքեր արժանապատվությունը նվաստացնելու սպառնալիքով  ցուցմունք են կորզել իրենից: Ինքն էլ սպառնալիքի և վախի ազդեցության տակ հայտնել է իրականության հետ կապ չունեցող հանգամանքներ:

Քրեական գործի նախաքննության ընթացքում մեղադրյալ Վ. Շ.-ն նույնպես Հատուկ քննչական ծառայությունում բացատրությամբ հայտնել է, որ ոստիկանության Արմավիրի բաժնի աշխատակիցներն ավազակության և գողության դեպքերով տեղեկություններ ու խոստովանություն ստանալու նպատակով հարվածել և մարմնական վնասվածքներ են պատճառել իրեն: 

Այսպիսով, ՀՀ ոստիկանության պետական հատուկ ծառայություն իրականացնող մի խումբ պաշտոնատար անձանց կողմից խոշտանգում կատարելու վերը նշված դեպքերի առթիվ Հատուկ քննչական ծառայությունում քրեական գործեր են հարուցվել ՀՀ քրեական օրենսգրքի 309.1-րդ հոդվածի 2-րդ մասի 4-րդ կետով: Ընդ որում, ելնելով լրիվ, բազմակողմանի և օբյեկտիվ նախաքննության անհրաժեշտությունից, հիշյալ գործերը միացվել և քննվում են մեկ վարույթում:

Կատարվում է նախաքննություն:

Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեականդատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
