ՄԻՊ-ը և ՓՊ-ն դատապարտում են փաստաբան Արայիկ Պապիկյանի նկատմամբ սպառնալիքների վարքագիծը

Հայաստանի Հանրապետության փաստաբանների պալատը դատապարտում է մասնագիտական պարտականությունների կատարման կապակցությամբ փաստաբան Արայիկ Պապիկյանի և նրա ընտանիքի անդամների հասցեին սպառնալիքներ պարունակող նամակներ ուղարկելու վարքագիծը: Ինչպես տեղեկացրին ՀՀ փաստաբանների պալատի մամուլի ծառայությունից, ՓՊ նախագահ Արա Զոհրաբյանն իր հայտարարությունում նշել է:
«Փաստաբանության մասին» ՀՀ օրենքի 22-րդ հոդվածի համաձայն՝ փաստաբանը, նրա ընտանիքի անդամները և նրանց գույքը գտնվում են պետության պաշտպանության ներքո։ Պետական իրավասու մարմինները պարտավոր են ձեռնարկել փաստաբանի պաշտպանության համար անհրաժեշտ` օրենքով սահմանված միջոցներ, եթե իր մասնագիտական պարտականությունների կատարման հետ կապված՝ նրան կամ նրա ընտանիքի անդամներին սպառնացել են ֆիզիկական բռնությամբ, գույքի ոչնչացմամբ կամ այլ անօրինական գործողություններով:
ՀՀ քրեական օրենսգրքի 323.3 հոդվածը քրեական պատիժ է նախատեսել այն անձի համար, որը փաստաբանի նկատմամբ սպանության, առողջությանը վնաս պատճառելու, գույքը ոչնչացնելու կամ վնասելու սպառնալիք է ներկայացրել` կապված փաստաբանի լիազորությունների իրականացման հետ:
Դեպքի առթիվ փաստաբան Արայիկ Պապիկյանի կողմից արդեն իսկ հաղորդում է ներկայացվել ՀՀ հատուկ քննչական ծառայությանը:
Միջադեպի կապակցությամբ իրավապահ մարմիններին կոչ ենք անում ձեռնարկել համապատասխան միջոցներ՝ փաստաբան Արայիկ Պապիկյանի և նրա ընտանիքի անդամների նկատմամբ սպառնալիքներ ներկայացրած անձին հայտնաբերելու և պատասխանատվության ենթարկելու համար, իսկ անհրաժեշտության դեպքում ձեռնարկել փաստաբանի պաշտպանության համար միջոցներ»,- ասել է Զոհրաբյանը:
ՀՀ փաստաբանների պալատի նախագահը նշված հարցով գրությամբ դիմել է նաև ՀՀ գլխավոր դատախազին:
Հայտարարությամբ հանդես եկել նաև ՀՀ մարդու իրավունքների պաշտպանը:
«Մասնագիտական գործունեություն
Այս պահի դրությամբ ի գիտություն է ընդունվել, որ Պապիկյանը իրավապահ մարմիններին ներկայացրել է հանցագործության մասին հաղորդում: Մարդու իրավունքների պաշտպանի կողմից արդեն իսկ համապատասխան գրություն է հասցեագրվել իրավասու մարմիններին: Պաշտպանի աշխատակազմը կապի մեջ է նաև Պապիկյանի հետ»,- ասված է ՄԻՊ հայտարարությունում:
