ՀՀ քննչական կոմիտեն ավարտել է բռնության գործադրմամբ երեխաներին շահագործելու դեպքով քրգործի նախաքննությունը

ՀՀ քննչական կոմիտեի հատկապես կարևոր գործերի քննության գլխավոր վարչությունում ավարտվել է բռնության գործադրմամբ երեք երեխայի շահագործման ենթարկելու դեպքի առթիվ հարուցված քրեական գործի նախաքննությունը:
Ինչպես «Արմենպրես»-ին տեղեկացրին ՀՀ քննչական կոմիտեից՝ քրեական գործի նախաքննությամբ պարզվել է, որ Արմավիրի մարզի Մուսալեռ գյուղի բնակիչը՝ ծնված 2000թ., համագյուղացի երեք անչափահաս երեխաներին՝ ծնված 2003, 2007 և 2008 թ.թ., շահագործելու նպատակով, խաբեությամբ՝ ճոճոնակ նստելու և զվարճանալու պատրվակով, 2016թ. ամռանը Մուսալեռ գյուղից տեղափոխել է «Զվարթնոց» օդանավակայանի հարակից տարածք և պահանջել օդանավակայանի ավտոկայանատեղիում գտնվող ավտոմեքենաների վարորդներից մուրացկանությամբ գումար հավաքել ու տալ իրեն: Երեխաները մերժել են, որից հետո 17-ամյա տղան նրանց նկատմամբ բռնություն է գործադրել՝ ծեծել, ու ստիպել զբաղվել մուրացկանությամբ, իսկ ինքը որոշակի տարածությունից հսկել է նրանց: Ընդ որում՝ երեխաներից մեկը տառապել է «Իզոլացված էպիլեպսիա» հիվանդությամբ։
Քննությամբ ձեռք բերված ապացույցների համաձայն՝ այդ ընթացքում անչափահաս երեխաները օդանավակայանի տարածքում գտնվող ավտոմեքենաների վարորդներից մուրացկանությամբ ստացել են թղթադրամներ ու մետաղադրամներ, որոնք, 17-ամյա տղայի ցուցումով, կուտակել են նրանցից մեկի մոտ: Շուրջ երկու ժամ գումար մուրալուց հետո երեխաները մոտեցել են 17-ամյա տղային, հանձնել նրան մուրացկանությամբ հավաքված ողջ գումարը: Հավաստիանալու համար, որ նրանց մոտ այլ գումար չի մնացել վերջինս ստուգել է երեխաների գրպանները, որից հետո հավաքված գումարից չնչին մաս տվել է երեխաներին, իսկ մնացածը տնօրինել անձամբ:
Ձեռք բերված բավարար ապացույցների համակցությամբ՝ 17-ամյա տղային մեղադրանք է առաջադրվել՝ ՀՀ քրեական օրենսգրքի 132.2-րդ հոդվածի 2-րդ մասի 1-ին և 4-րդ կետերով (բռնություն գործադրելով կամ դա գործադրելու սպառնալիքով երկու կամ ավելի երեխաների շահագործումը):
Քրեական գործը՝ մեղադրական եզրակացությամբ, ուղարկվել է դատարան:
Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարությանօրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
