Ավարտվել է Աշտարակ քաղաքի բնակչի սպանության դեպքի առթիվ հարուցված քրեական գործի նախաքննությունը

ՀՀ քննչական կոմիտեի ՀԿԳ քննության գլխավոր վարչությունում ավարտվել է Աշտարակ քաղաքի բնակիչ՝Հ.Մովսիսյանի սպանության դեպքի առթիվ հարուցված քրեական գործի նախաքննությունը: Ինչպես տեղեկացրին ՀՀ քննչական կոմիտեից, մեղադրանք է առաջադրվել մեկ անձի: 2017թ. ապրիլի 10-ին Աշտարակ-Գյումրի ավտոճանապարհից մոտ 250 մետր հեռավորության վրա գտնվող վագոն տնակում հայտնաբերվել էր Աշտարակ քաղաքի բնակիչ Հ.Մովսիսյանի դին՝ հրազենային բազմաթիվ վնասվածքներով: Դեպքի առթիվ հարուցված քրեական գործով ձեռնարկված մեծածավալ քննչական գործողությունների արդյունքում պարզվել են դեպքի մի շարք հանգամանքներ, շարժառիթը, առերևույթ հանցագործություն կատարած անձի ինքնությունը, ով հանդիսանում է Աշտարակի քաղաքի 46-ամյա բնակիչը: Մասնավորապես՝ նախնական քննությամբ փաստական տվյալներ են ձեռք բերվել առ այն, որ Հ.Մովսիսյանի և 46-ամյա տղամարդու միջև, ովքեր եղել են մտերիմ հարաբերությունների մեջ, 2017թ. ապրիլի 10-ին Աշտարակ քաղաքում գտնվող վագոն տնակում կենցաղային հարցերի շուրջ վիճաբանություն է սկսվել, որի ժամանակ 46-ամյա տղամարդն ինքնաձիգից կրակահերթ է արձակել Հ.Մովսիսյանի ուղղությամբ՝ պատճառելով կյանքի հետ անհամատեղելի մարմնական վնասվածքներ։ Ապա հանցագործության գործիք հանդիսացող ինքնաձիգն ու վագոն տնակում առկա մյուս ինքնաձիգը 46-ամյա տղամարդը դրել է տուժողի «ՎԱԶ 2107» մակնիշի ավտոմեքենայի սրահում և նշված ավտոմեքենայով դիմել փախուստի՝ ուղևորվելով Աշտարակ քաղաքի հրապարակի ուղղությամբ, սակայն ճանապարհին վթարի է ենթարկվել՝ բախվելով մի քանի ավտոմեքենաներիև, մեքենան թողնելով վթարի վայրում, հեռացել է: Ձեռնարկված միջոցառումների արդյունքում՝ տղամարդը հայտնաբերվել է և ներկայացվել վարույթն իրականացնող մարմնին։ Մինչ դատական վարույթում ձեռք բերված բավարար ապացույցների համակցությամբ՝ 46-ամյա տղամարդուն մեղադրանք է առաջադրվել՝ ՀՀ քրեական օրենսգրքի 104-րդ հոդվածի 1-ին մասով և 235-րդ հոդվածի 1-ինմասով: Նրա նկատմամբ որպես խափանման միջոց է ընտրվել կալանավորումը: Քրեական գործը՝ մեղադրական եզրակացությամբ, ուղարկվել է նախաքննության օրինականության նկատմամբ հսկողություն իրականացնող դատախազին:
Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով դատարանի` օրինական ուժի մեջ մտած դատավճռով:
