Քննությամբ պարզվել է ԴԱՀԿ առանձին ծառայողների կողմից կատարողական վարույթի ընթացքն անհիմն ձգձգելու հանգամանքը

ՀՀ քննչական կոմիտեի Կոտայքի մարզային քննչական վարչության Աբովյանի քննչական բաժնում քննվող քրեական գործով բազմակողմանի քննության արդյունքում փաստական տվյալներ են ձեռք բերվել, որ ԴԱՀԿ առանձին ծառայողների կողմից պատշաճ չեն կատարվել օրենքով սահմանված իրենց ծառայողական պարտականությունները, և անհիմն ձգձգվել է կատարողական վարույթի ընթացքը: Ինչպես տեղեկացրին քննչական կոմիտեից, ՀՀ ՔԿ Կոտայքի մարզային քննչական վարչության Աբովյանի քննչական բաժնում ստացվել էր ՀՀ ԱՆ ԴԱՀԿ ծառայության գրությունն առ այն, որ ՀՀ Կոտայքի մարզի ընդհանուր իրավասության դատարանի կողմից 22.05.2016թ. տրված թիվ ԿԴ/0637/02/11 կատարողական թերթի համաձայն՝ պետք է պարտավորեցնել պատասխանող ՍՊԸ-ին՝ վերականգնել հայցվոր ՍՊԸ-ի սեփականություն հանդիսացող՝ դեպի խիճը տանող ճանապարհը և վերացնել ՍՊԸ-ի սեփականատիրական իրավունքի խախտումները: Սակայն պատասխանող ՍՊԸ-ի տնօրենը հայտարարել է, որ չի կարող կատարել կատարողական թերթի պահանջները:
Դեպքի առթիվ ՀՀ ՔԿ Աբովյանի քննչական բաժնում հարուցվել է քրեական գործ՝ ՀՀ քրեական օրենսգրքի 353-րդ հոդվածի 2-րդ մասով:
Քրեական գործով կատարված բազմակողմանի քննության արդյունքում փաստական տվյալներ են ձեռք բերվել, որ իրականում ՀՀ ԱՆ դատական ակտերի հարկադիր կատարումն ապահովող ծառայության Կոտայքի մարզային բաժնի Աբովյանի բաժանմունքի համապատասխան աշխատակիցները չեն կատարել օրենքով սահմանված իրենց ծառայողական պարտականությունները և, խախտելով ՀՀ դատական ակտերի հարկադիր կատարման մասին օրենքի 34-րդ հոդվածի պահանջները, ոչ պատշաճ ընթացակարգով, սահմանված ժամկետների խախտումներով, անձնական այլ շահագրգռվածությունից դրդված՝ անհիմն ձգձգել են կատարողական վարույթի ընթացքը, որով էական վնաս է պատճառվել ՍՊ ընկերության իրավունքներին և օրինական շահերին:
