Անահիտ Բախշյանը կողմնակից է երեխային դպրոցից բռնությամբ զրկող ծնողների նկատմամբ տուգանքի կիրառմանը. «Փաստ»

«Փաստ» օրաթերթը գրում է.
Վերջերս «Հայկական ժամանակ» օրաթերթում մի հոդված հայտնվեց, որտեղ լրագրողի հարցերին պատասխանող Կրթության և գիտության նախարարության հանրակրթության վարչության պետ Աշոտ Արշակյանը ասել էր, թե երեխաներին դպրոց չուղարկող ծնողները կարող են տուգանվել: Վերջինս հավելել էր, որ այդ մասին ասված է Վարչական իրավախախտումների վերաբերյալ օրենսգրքում:
Մասնավորապես, օրենսգրքի 178–րդ հոդվածով ծնողների կամ նրանց փոխարինող անձանց կողմից անչափահաս երեխաների դաստիարակության և ուսուցման պարտականությունները չարամտորեն չկատարելը առաջացնում է տուգանքի նշանակում ծնողների կամ նրանց փոխարինող անձանց նկատմամբ` սահմանված նվազագույն աշխատավարձի երեսնապատիկի չափով:
Խնդրի շուրջ «Փաստը» զրուցել է Երևանի ավագանու «Ելք» խմբակցության անդամ Անահիտ Բախշյանի հետ, ով նույնպես կողմ է այս որոշմանը: Իսկ թե ինչո՞ւ է կողմ, այսպես է բացատրում:
– Ընտանեկան օրենսդրության մեջ այդ նորմը կա: Այսինքն՝ եթե ծնողի կողմից խոչընդոտվում է երեխայի կրթության իրավունքը, ապա նա պետք է ենթարկվի պատասխանատվության: Չզարմանաք, բայց ես համամիտ եմ սրա հետ: Բոլոր այն դեպքերում, որոնք շատ քիչ են, բայց կան, երբ ծնողի պատճառով երեխան զրկվում է կրթությունից, պետք է տուգանել:
Կոնկրետ օրինակ գիտեմ, երբ հայրը մորից անհայտ ուղղությամբ փախցրել էր երեխային, և երեխան 7 ամիս դպրոց չի հաճախել: Սա վերաբերում է այն դեպքերին, երբ ծնողի պատճառով երեխան զրկվում է կրթությունից: Իսկ բոլոր այն դեպքերում, երբ ծնողը սոցիալական կամ այլ պատճառներով՝ հեռու գտնվող դպրոց կամ կոշիկի ու հագուստի բացակայություն, երեխային դպրոց չի տանում, ապա չեն տուգանվի: Այս դեպքերում պետությունը նրանց հայտնաբերելով՝ պետք է պարտավորություն ստանձնի ապահովել պայմաններ, որպեսզի երեխան գնա դպրոց, որովհետև Սահմանադրությամբ մենք սոցիալական երկիր ենք:
– Բայց իշխանությունները կգնա՞ն դրան: Եվ չէ՞ որ բազմաթիվ են ընտանիքները, որոնց երեխաները դպրոց չեն հաճախում հենց հագուստ և գրենական պիտույքներ գնել չկարողանալու պատճառով: Եվ ի վերջո արդարացի՞ կկատարվի այդ տարանջատումը:
– Որքան էլ մենք քննադատում ենք, այս պարագայում ես չեմ հավատում, թե սոցիալական խնդիրների պատճառով երեխային դպրոց չտանելը պետք է տուգանքի համար առիթ հանդիսանա: Բայց քանի որ ես անձամբ երկու դեպք գիտեմ, երբ ծնողը բռնությամբ իր երեխային դպրոցից զրկել է, ապա այս դեպքերի համար նման տուգանքի կիրառման կողմնակից եմ:
Միայն այդ առումով է կիրառվելու, համոզված եմ: Իսկ այն ծնողները, ովքեր հնարավորություն չունեն դպրոց տանելու, թող պետությանը դատի տան: Եթե Սահմանադրությամբ երեխայի կրթությունը պարտադիր է, դա նշանակում է, որ պետությունը պարտավորվում է ապահովել երեխաների կրթությունը ցանկացած ընտանիքի համար:
– Հավատո՞ւմ եք, որ մեզ մոտ դա հնարավոր է:
– Հավատալը իրավական կատեգորիա չէ: Ոչ թե պիտի հավատալ, այլ՝ պահանջել: Քանի դեռ ծնողը, ով լացում է ու ասում, թե իր երեխան կոշիկ չունենալու պատճառով դպրոց չի գնացել ու նա ՏԻՄ մարմնի գլուխը չի ջարդել դրա համար, ուրեմն մենք միայն նվնվալու ենք:
– Խնդիրը հենց նրանում է, որ այդ խավի մարդիկ պահանջատեր չեն և իրենց իրավունքներն այնքան էլ լավ չգիտեն:
– Դե, հիմա մեր ամբողջ խնդիրը` հասարակության մեջ արմատացած աղբի հիմքում այն է, որ հասարակության մեջ իրավագիտակցությունը շատ ցածր է: Իրենք պետք է իրենց իրավունքները ճանաչեն ու պահանջեն, և հասարակությունն ավելի գրագետ կդառնա:
