Հայկական արդարադատության բացը, կամ կրկին 3000 եվրո կվճարենք

Հայաստանի Արդարադատության նախարարությունը ստիպված է կրկին գումար վճարել իր կողմից իրականացված կամ ավելի ճիշտ է ասել՝ չիրականացված արդարադատության պատճառով: Բանն այն է, որ Եվրադատարանում հերթական պարտություն կրելու հետևանքով, նախարարությունը 3 հազար եվրոյին համարժեք գումար կվճարի «Հովհաննիսյանն ընդդեմ Հայաստանի» գործով դիմումատուին: Այս մասին որոշման նախագիծը գործադիրի հերթական նիստին կներակայացվի հինգշաբթի օրը:
Այսպես, ըստ նախագծին կցված նյութերի՝ Մարդու իրավունքների եվրոպական դատարանը հուլիսի 20–ին հրապարակել է «Հովհաննիսյանն ընդդեմ Հայաստանի» գործով վճիռը, որով արձանագրել է Մարդու իրավունքների եվրոպական կոնվենցիայի 5–րդ հոդվածի 3–րդ կետի խախտում:
Եվրոպական դատարանը փաստել է, որ ներպետական դատարաններին չեն ներկայացվել հիմնավոր և բավարար պատճառներ՝ դիմումատուի նկատմամբ կալանք նշանակելու և կալանքի ժամկետը երկարացնելու մասին միջնորդությունների հիմնավորման համար։ Եվրոպական դատարանը նշել է, որ առաջին ատյանի դատարանը բավարարվել է իր որոշման մեջ միայն վերացական և կարծրատիպային ձևակերպումներ տալով՝ իր պատճառաբանությունը պարզապես սահմանափակելով Քրեական դատավարության օրենսգրքի 135–րդ հոդվածի համապատասխան մասերի հիշատակմամբ:
Նշենք, որ դիմումատուն պահանջել է 1 միլիոն 648 հազար դրամ՝ որպես նյութական վնասի հատուցում, 70 հազար եվրո՝ որպես ոչ նյութական վնասի հատուցում, ինչպես նաև ևս 3 միլիոն դրամ՝ որպես ներպետական դատարաններում և Եվրոպական դատարանում կրած ծախսերի և ծախքերի հատուցում։ Գործի քննության արդյունքում Եվրոպական դատարանը վճռել է դիմումատուին շնորհել 3 հազար եվրո ոչ նյութական վնասի դիմաց:
Այսպես, Մարդու իրավունքների եվրոպական դատարանի «Հովհաննիսյանն ընդդեմ Հայաստանի» գործով վճռի պահանջները կատարելու նպատակով 2017 թ. պետական բյուջեով նախատեսված կառավարության պահուստային ֆոնդի հաշվին Արդարադատության նախարարությանը կհատկացվի 3 հազար եվրոյին համարժեք դրամ` վճռով սահմանված արդարացի հատուցման համար:
