Կառավարությունը մերժեց «Ելք»-ին

Այսօր ՀՀ կառավարությունը նիստում մերժեց ԱԺ «Ելք» խմբակցության պատգամավորներ՝ Նիկոլ Փաշինյանի, Մանե Թանդիլյանի, Արտակ Զեյնալյանի և Գևորգ Գորգիսյանի ներկայացրած օրենսդրական նախաձեռնությունը: ՀՀ արդարադատության նախարար Դավիթ Հարությունյանն ասաց, թե պատգամավորներն առաջարկում են ձերբակալված և կալանավորված անձանց պահելու մասին օրենքում կատարել փոփոխություն, որը վերաբերում է որոշակի դեպքում վարույթ իրականացնող մարմնի, քննիչի կողմից տեսակցությունները կալանավորված անձի հետ սահմանափակելուն:
Դավիթ Հարությունյանն ասաց, թե պատգամավորներն առաջարկում են, որպեսզի նշվի, որ այդ սահմանափակումը չի տարածվում այն անձանց վրա, ովքեր իրավունք ունեն անարգել մուտք ու ելք անել քրեակատարողական հաստատություն:
«Առաջին հայացքից թվացյալ պարզ հարցը իրականում շատ ավելի խորն իմաստ ունի: Բանն այն է, որ այսօր օրենսդրությունը երկու տարբեր հասկացություն է տարանջատում՝ անարգել մուտք ու ելքն ու տեսակցությունը. անարգել ելք ու մուտքի հետ կապված բազում պաշտոնատար անձինք այդ իրավունքն ունեն՝ ՀՀ նախագահը, վարչապետը Սահմանադրական դատարանի նախագահը, պատգամավորները և այլք: Բայց տեսակցության հետ կապված կան լրիվ այլ կարգավորումներ՝ կա ստանդարտ ռեժիմ տեսակցություն ցանկանալու և կա ռեժիմ, որ անկախ նրանից` քննիչը արգելանք դրել է, թե ոչ, անձն իրավունք ունի տեսակցելու: Հիմա պատգամավորներն առաջարկում են, որ որպեսզի դրանց և մյուս պաշտոնատար անձանց համար քննիչի արգելքը չգործի, ինչը մենք համարում ենք անթույլատրելի, քանի որ շատ մեծ թվով անձիք ստանում են հնարավորություն կալանավորված անձանց հետ տեսակցելու»,-ասաց նա:
Դավիթ Հարությունյանը տեղեկացրեց, որ այդ իրավունքից այսօր օգտվում է Մարդու իրավունքների պաշտպանը, խոստովանահայրը և եթե կալանավորված անձը դատավոր է, այդ իրավունքից օգտվում է նաև վճռաբեկ դատարանի նախագահը: «Մենք նպատակահարմար չենք համարում ընդլայնել տեսակցություն ունեցող անձանց շրջանակը, եթե քննիչն արգելանք է դրել տեսակցությունների վրա»,- նշեց նա:
Վարչապետ Կարեն Կարապետյանը հարցրեց, թե ընդհանրապես նման պրակտիկա որևէ երկրում կա՞։ Դավիթ Հարությունյանը պատասխանեց, որ եթե խոսքը վերաբերում է քննությանը, ապա միշտ ցանկություն կա սահմանափակելու միայն այն պաշտոնատար անձանց հետ, ովքեր ֆունկցիոնալ կապ ունեն կալանավորված անձի հետ, և Մարդու իրավունքների պաշպանը, խոստովանահայրն ունեն այդ կապը: «Կան երկրներ, որտեղ կա նման պրակտիկա, բայց դա չի նշանակում, որ մենք պետք է գտնենք մի երկիր, որ նման պրակտիկա կա և անպայման բերենք Հայաստան»,-ավելացրեց նախարարը:
