2017 թվականի սեպտեմբերի 1-ի դրությամբ ՀՀ արդարադատության նախարարության քրեակատարողական հիմնարկներում պահվում է թվով 3754 անձ, որոնցից թվով 97-ը՝ ցմահ ազատազրկման դատապարտված:

Նշված 97 անձանցից թվով 13-ը պահվում են կիսափակ ուղղիչ հիմնարկում, իսկ թվով 84-ը՝ փակ ուղղիչ հիմնարկում: 2003 թվականի ապրիլի 18-ից առ այսօր ցմահ ազատազրկման դատապարտված անձինք պայմանական վաղաժամկետ չեն ազատվել և նրանց նկատմամբ նշանակված պատժի չկրած մասն ավելի մեղմ պատժատեսակով չի փոխարինվել: Այս տվյալները Tert.am-ի գրավոր հարցմանն ի պատասխան հայտնել են ՀՀ արդարադատության նախարարությունից:

Ցմահ ազատազրկման դատապարտվածների թվի, 2003-ից հետո պայմանական վաղաժամկետ ազատման դեպք չգրանցվելու մասին Tert.am-ը զրուցեց ցմահ դատապարտյալ Արթուր Մկրտչյանի պաշտպան Ռոբերտ Ռևազյանի հետ:

«Այս պահի դրությամբ ՀՀ ՔԿՀ-ներում 25 ցմահ դատապարտյալ կա, ով հատել է պատժի կրման 20 տարվա շեմը և վաղաժամկետ ազատ չի արձակվել:Այսինքն` վաղաժամկետ ազատ արձակվելու շեմը հատել է ցմահ դատապարտյալներից 25-ը: Հարցը երկու տեսակետից կարող ենք նայել՝ կամ մեր քրեակատարողական համակարգը իր հիմնական գործառույթը չի կարողանում իրականացնել, որ որևէ մեկը փաստորեն չի ուղղվել, որոշում կա, որ այդ անձանց չպետք է ազատ արձակել: Կարծում եմ, որ երկրորդ հանգամանքն է գործում տվյալ դեպքում, կա քաղաքական որոշում, որ որևէ ցմահ ազատազրկման դատապարտված անձ ազատ չարձակվի»,-ասաց Ռևազյանը:

Ռևազյանը համամիտ չէ այն ձևակերպումների հետ, որ վերջնական խոսքը դատարանինն է: Փաստաբանի խոսքով՝ դա Հայաստանում չի գործում և դատարանները դեռևս չունեն անկախության այն աստիճանը, որ նման գործերում սկզբունքային որոշում կայացնեն:

«Փաստերով նշեմ, որ եթե դրական վարքագիծ է դրսևորել դատապարտյալը, միևնույն է վաղաժամկետ ազատ չի արձակվում, էլ չեմ ասում, որ տրամադրվող բնութագրերը շատ դեպքերում օբյեկտիվ հիմնավորում չեն պարունակում: Նշվում է, որ օրինակ, դատապարտյալը չի մասնակցել հանրօգուտ միջոցառման կամ հասարակական միջոցառումների:

Սակայն, թե ինչ միջոցառում է իրականացվել, որին է տեղյակ եղել դատապարտյալը, որին չի մասնակցել, կամ առհասարակ կարողանում էր այդ միջոցառումներին մասնակցել, թե ոչ, այդ հարցը երբեք քննարկման առարկա չեն դարձնում»:

Փաստաբանի կարծիքով՝դիրքորոշումը ձևավորվում է, հետո նոր փորձ է արվում ձևավորել այդ դիրքորոշումը, ոչ թե այդ դիրքորոշումը արդեն առկա փաստերից կամ իրավիճակից է բխում:

Նշենք, որ 1997-ին Արմեն Մկրտչյանը դատապարտվել է մահապատժի՝ համածառայակիցների սպանության մեղադրանքով: 2003-ին մահապատիժը փոխարինվել է ցմահ ազատազրկմամբ: 20 տարի պատիժ կրող կալանավորը երբևէ չի ընդունել իրեն առաջադրված մեղադրանքը և պնդում է, որ ոչ ոքի չի սպանել:
