«Հաղթանակ» կամրջին մահվան ելքով վթարի դեպքի առթիվ քննվող գործով մեղադրանք է առաջադրվել ավտոմեքենայի վարորդին

ՀՀ քննչական կոմիտեի Երևան քաղաքի քննչական վարչությունում քննվող քրեական գործով պարզվել են  «Հաղթանակ» կամրջի վրա «Ինֆինիտի» մակնիշի ավտոմեքենայի վթարի ենթարկվելու հանգամանքները, վարորդին առաջադրվել է մեղադրանք։ Այս մասին «Արմենպրես»-ին տեղեկացրին ՀՀ քննչական կոմիտեից՝ հավելելով․«2017թ. օգոստոսի 30-ին ահազանգ է ստացել, որ  ժամը 04:40-ի սահմաններում, «Ինֆինիտի» մակնիշի ավտոմեքենան Երևան քաղաքի «Հաղթանակ» կամրջով Արգիշտի փողոցի ուղղությամբ ընթանալիս դուրս է եկել ճանապարհի երթևեկելի գոտուց և գլորվել ձորը, ինչի հետևանքով մեկ անձ  մահացել է, երկուսը՝  ծանր մարմնական վնասվածքներով տեղափոխվել բժշկական կենտրոն:

Դեպքի առթիվ ՀՀ ՔԿ Երևան քաղաքի քննչական վարչությունում հարուցվել է քրեական գործ՝ ՀՀ քրեական օրենսգրքի 242-րդ հոդվածի 2-րդ մասով, ձեռնարկված անհրաժեշտ միջոցառումների արդյունքում պարզվել են ավտովթարի էական նշանակություն ունեցող մի շարք հանգամանքներ:

Նախնական քննությամբ փաստական տվյալներ են ձեռք բերվել, որ «Ինֆինիտի» մակնիշի ավտոմեքենայի վարորդը, Երևան քաղաքի «Հաղթանակ» կամրջով Արգիշտի փողոցի ուղղությամբ ընթանալիս,  նկատել է իր ընթացքի ուղղությամբ ձախից դեպի աջ փողոցը հատող կենդանու և, խախտելով «Ճանապարհային երթևեկության անվտանգության ապահովման մասին» ՀՀ օրենքի պահանջները, արագությունն իջեցնելու` ընդհուպ մինչև տրանսպորտային միջոցը կանգնեցնելու փոխարեն՝  մեքենայի ղեկը կտրուկ ձախ ու աջ մանևրելով՝ կորցրել է իր վարած տրանսպորտային միջոցի կառավարումը։ Արդյունքում՝ հարվածել ու կոտրել է կամրջի պաշտպանիչ մետաղյա ճաղավանդակը և ընկել ձորը, ինչի հետևանքով ավտոմեքենայի ուղևորներից մեկն ստացած մարմնական վնասվածքներից մահացել է:

Քննությամբ պարզվել է, թե վթարի պահին ով է գտնվել ավտոմեքենայի ղեկին, ում մեղադրանք է առաջադրվել՝ ՀՀ քրեական օրենսգրքի 242-րդ հոդվածի 2-րդ մասով։

Նշանակվել են դիակի դատաբժշկական, դատաբժշկական, դատամանրաթելային, դատաավտոտեխնիկական, դատաքիմիական փորձաքննություններ:

Նախաքննությունը շարունակվում է: Ձեռնարկվում են անհրաժեշտ քննչական և դատավարական այլ միջոցառումներ դեպքի հանգամանքների օբյեկտիվ, լրիվ և բազմակողմանի քննությունն ապահովելու ուղղությամբ:

Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորություննապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտածդատավճռով»:
