Վարչական գործերն ուշ քննելու պատճառը միայն դատավորների թիվը չէ, այլ նրանց մարդկային գործոնը. փաստաբանը` ԱՆ-ի նախագծի մասին

ՀՀ արդարադատության նախարար Դավիթ Հարությունյանը կառավարության հավանությանն է ներկայացրել օրենսդրական փոփոխությունների փաթեթ, որով առաջարկվում է վարչական վերաքննիչ դատարանի դատավորների թիվը ավելացնել 3-ով:

Առաջարկվող փոփոխության վերաբերյալ Tert.am-ի հետ զրույցում փաստաբան Գևորգ Գյոզալյանն ասաց, որ երեք դատավոր՝ այսինքն մեկ կազմ է ավելացվում,որի կարիք կա, սակայն գործերի ուշ քննելու պատճառը միայն դատավորների թիվը չէ:

«Ես կարծում եմ, որ դա պահանջված է, որովհետև ակնհայտ է, որ ծանրաբեռնված է, բայց միանշանակ պնդել, որ այդ ծանրաբեռնվածությունը բացառապես դատավորների քանակի պակասով է պայամանավորված սխալ է , որովհետև եթե նրանք մի քիչ փորձեն այդ ծանրաբեռնվածության բովանդակային մասին ծանոթանան, ապա կպարզեն, որ այնտեղ ոչ կոմպետենտ դատավորների քանակն է մեծ, ոչ ճիշտ «վարչարարության» իրականացումը և այլն, դրան զուգահեռ պետք է բարելավել դատավորների որակը, կախված, թե ինչ դատավոր է, որովհետև ակնհայտորեն ունենք շատ դեպքեր, որ դատավորների անձով է պայմանավորված, որ գործերի քննությունը երկար է տևում: Ուստի սրանք իրար փոխլրացնող միջոցառումներ պետք է լինեն»,-ասաց Գյոզալյանը:

Հարցին,թե ինչ են անում կամ չեն անում դատավորները, որ գործերի քննությունը երկար է տևում, Գյոզալյանն ասաց, որ օրինակ մի գործով դատավորը նիստ է նշանակում երկու ամիսը մեկ, հանկարծ նիստի օրը պարզվում է, որ դատավորը սեմինարի է մասնակցում, կամ հիվանդացել է, կամ գտնվում է արձակուրդում:

«Սրա մասին բազմիցս խոսել ենք, որպեսզի կանոնակարգվի: Այստեղ է այդ խնդիրն առաջանում, որովհետև եթե տարեկան հերթական արձակուրդը չի կազմակերպվում այնպես, որ մարդն իմանա և այդ օրը չնշանակի նիստ, ապա սա «վարչարարության» խնդիր է»,-ասաց փաստաբանը:

Վերջինս օրինակ բերեց մեկ գործ, որը Գեղարքունիքի մարզում է: Փաստաբանի խոսքով դատավոր Ավագ Գաբրիելյանը վեց ամիս է նիստ չի նշանակում, և նրա աշխատակազմից ասում են, որ մինչև ԴԱՀԿ-ը չկատարի ապահովման միջնորդության որոշման կատարումը, նիստը չի նշանակվի.« Ասում եմ՝ այսինքն արդարադատության իրականացումը կախվածության մեջ եք դրել ԴԱՀԿ-ից ու հայցվոր կողմից: Հայցվոր կողմը կարող է այդ որոշումը չներկայացնի դատարան, կամ ԴԱՀԿ-ը դա չկատարի, ստացվում է, որ նիստ չի՞ նշանակելու: Այստեղ մենք անձի խնդիր ունենք, ոչ թե օրենքի: Դիմել եմ վարչապետին, արդարադատության խորհուրդ, և քար լռություն է: Հետևաբար, եթե խոսում են դատավորիների քանակի, ծանրաբեռնվածության մասին և այլն, ինձ մոտ ժպիտ է առաջացնում»:

Փաստաբանն ասաց, որ թերևս այդ խնդիրը կա, սակայն դատավորների հետ կապված ավելի լուրջ խնդիր կա: Նրա խոսքով՝ այլ երկներում, օրինակ Գերմանիայի դատարաններում քիչ թվով դատավորներ ավելի շատ գործեր են քննում:

Նշենք, որ նախագծում ներկայացված է նաև վիճակագրություն, թե քանի գործ է ստացվել Վարչական վերաքննիչ դատարանում և քանիսն է հասցրել ավարտին:

2011թ.` 1496 գործ (որից` 2010թ.-ից փոխանցված` 91 գործ), ավարտվել է 1264 գործ,

2012թ.` 1820 գործ (որից` 2011թ.-ից փոխանցված` 232 գործ), ավարտվել է 1495 գործ

2013թ.` 2343 գործ (որից` 2012թ.-ից փոխանցված` 325 գործ), ավարտվել է 1866 գործ,

2014թ.` 2314 գործ (որից` 2013թ.-ից փոխանցված` 477 գործ), ավարտվել է 1816 գործ,

2015թ.` 2321 գործ (որից` 2014թ.-ից փոխանցված` 496 գործ), ավարտվել է 1796 գործ,

2016թ.` 2773 գործ (որից` 2015թ.-ից փոխանցված` 525 գործ), ավարտվել է 1626 գործ,

2017թ. հունիս ամիսը ներառյալ` 3149 գործ (որից` 2016թ.-ից փոխանցված` 1147 գործ), ավարտվել է` 1166 գործ, անավարտ` 1983 գործ:
