 Ինչպես գործող Սահմանադրությունը, այնպես էլ սահմանադրական փոփոխությունների նախագիծը չի ամրագրում, որ քաղաքացին Սահմանադրական դատարանում կարող է վիճարկել նախագահի, կառավարության կամ ՏԻՄ հրամանագրերը, այսինքն՝ նախագահների կամ կառավարության հրամանագրերը, հանդիսանալով սահմանադրական վերահսկողության օբեյկտներ, չեն կարող վիճարկվել քաղաքացու կողմից, ինչը քաղաքացու իրավունքի խախտում է: Այդ մասին Past.am-ի հետ զրույցում ասաց «Անմեղության հայկական ծրագիր» ՀԿ-ի նախագահ, իրավապաշտպան Զարուհի Մեջլումյանը:

«Այն մտքին չեմ, որ կա Սահմանադրությունը փոխելու հասարակական պահանջ, մենք ունենք լավ օրենքներ, որոնք չեն գործում: Ոչ թե պետք է Սահմանադրություն փոխել, այլ Սահմանադրությունը կիրառողներին», - տեսակետ հայտնեց Մեջլումյանը:

Նրա խոսքով՝ Սահմանադրությունը մեղավոր չէ, որ խախտվում են շատ իրավունքներ, հակառակը, մարդու իրավունքների պահպանման, իրացման և հարգման համար Սահմանադրությունը տալիս է երաշխիքներ, որոնք չենք իրագործվում: Զարուհի Մեջլումյանը նշեց նաև, որ թե´ գործող Սահմանադրության, թե´ նոր Սահմանադրության մեջ չկա նախատեսված երդվյալ ատենակալների համակարգ՝ բացառելով մեկանձնյա դատավարության սկզբունքը:

Իրավապաշտպանը հիշեց, որ նման բան նախատեսված է եղել 1995 թվականի Սահմանադրության մեջ, սակայն չի կիրառվել:

«Ինքս կողմնակից եմ, որ Հայաստանում լինի ժյուրիով դատարան, ինչպես օրինակ՝ ԱՄՆ-ում, քանի որ ցանկացած ժամանակ մեկ անձի վրա հեշտ է ներազդել: Մի քանի կազմակերպություններ, որոնք ուսումնասիրում են ՀՀ-ում ոլորտների կոռումպացվածության ընկալումը հանրության շրջանում, դատաիրավական համակարգը մշտապես դասակարգում են կոռումպացվածների առաջին եռյակում»,- մանրամասնեց Մեջլումյանը՝ չմոռանալով նաև, որ ժյուրիով համակարգի պարագայում էլ կարող են լինել դատական սխալներ, սակայն տեսակետ հայտնեց, որ ներդրման դեպքում կունենանք հանրային վերահսկողության առկայություն:
