Ոստիկանության պաշտոնատար անձանց կողմից պաշտոնեական դիրքը չարաշահելու ու կեղծիք կատարելու մասին հաղորդում է ստացվել

ՀՀ հատուկ քննչական ծառայությունում քրեական գործեր են հարուցվել ՀՀ ոստիկանության պետական հատուկ ծառայություն իրականացնող պաշտոնատար անձանց կողմից պաշտոնեական դիրքը չարաշահելու և պաշտոնեական կեղծիք կատարելու դեպքերի վերաբերյալ ստացված հաղորդումների հիման վրա: Այս մասին «Արմենպրես»-ին տեղեկացրին ՀՔԾ լրատվական ծառայությունից:
Այսպես, 20.10.2017թ.-ին ՀՀ քաղաքացի Վ. Պետրոսյանը Հատուկ քննչական ծառայությունում հաղորդում է տվել, որ իր և ընկերուհու մասնակցությամբ կատարված հանցագործության դեպքի վայրի զննության ժամանակ ՀՀ ոստիկանության Նաիրիի բաժնի համայնքային ոստիկանության բաժանմունքի ավագ տեսուչը, չհայտնաբերելով հանցագործության գործիք հանդիսացող կացնի փայտե բռնակը, իրեն հանձնարարել է խանութից գնել նորը: Վ. Պետրոսյանը նոր գնած բռնակը ընկերուհու հետ տարել է դեպքի վայր, որտեղ տեսուչի հանձնարարությամբ մատնացույց են արել այն` որպես զննությամբ հայտնաբերված հանցագործության գործիք: Վ. Պետրոսյանը միաժամանակ հաղորդմամբ հայտնել է, որ նույն տեսուչն իր կազմած արձանագրությունում կեղծ տվյալներ է ներառել դեպքի վայրի զննությանը երկու ընթերակայի մասնակցության վերաբերյալ: Ըստ Վ. Պետրոսյանի` իրականում նշված գործողությանը մասնակցել է մեկ ընթերակա, իսկ երկրորդը արձանագրությունում ստորագրել է զննության ավարտից հետո` այլ վայրում:
ՀՀ ոստիկանության վերը նշված պաշտոնատար անձի կողմից պաշտոնեական դիրքը չարաշահելու և պաշտոնեական կեղծիք կատարելու դեպքերի առթիվ Հատուկ քննչական ծառայությունում հարուցվել է քրեական գործ` ՀՀ քրեական օրենսգրքի 308-րդ և 314-րդ հոդվածների 1-ին մասերով:
Մյուս քրեական գործը հարուցվել է ՀՀ ԱՆ «Նուբարաշեն» ՔԿՀ կալանավոր Մ. Առաքելյանի հաղորդման հիման վրա: Վերջինս հայտնել է, որ 24.08.2014թ.-ին ՀՀ ոստիկանության Երևան քաղաքի վարչության Նոր Նորքի բաժնի Ավանի բաժանմունքի պաշտոնատար անձինք իրեն բերման են ենթարկել Նոր Նորքի բաժին և 8 ժամ ապօրինի պահել այնտեղ: Բացի այդ, Մ. Առաքելյանը հայտնել է, որ մինչ բերման ենթարկվելը նույն բաժնի պաշտոնատար անձինք հեռախոսազանգերով սպառնացել են իրեն, ինչի հետևանքով վնաս է պատճառվել իր իրավունքներին և օրինական շահերին:
Այսպիսով, ՀՀ ոստիկանության պետական հատուկ ծառայություն իրականացնող պաշտոնատար անձանց կողմից պաշտոնեական դիրքը չարաշահելու վերը նշված դեպքի առթիվ հարուցվել է քրեական գործ` ՀՀ քրեական օրենսգրքի 308-րդ հոդվածի 1-ին մասով:
Կատարվում է նախաքննություն:
Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
