Ամրագոտին ամրացված չլինելու համար ոստիկանները 5000 ՀՀ դրամ կաշառք են պահանջել

ՀՀ հատուկ քննչական ծառայության քննիչի վարույթ է ընդունվել ՀՀ ոստիկանության պաշտոնատար անձանց կողմից բռնությամբ զուգորդված պաշտոնեական լիազորություններն անցնելու դեպքի առթիվ ՀՀ քննչական կոմիտեի Շիրակի մարզային քննչական վարչությունում հարուցված քրեական գործը:
Այսպես, քրեական գործի նյութերի նախապատրաստման ընթացքում ՀՀ ոստիկանության Արթիկի բաժնի համայնքային ոստիկանության բաժանմունքի տեսուչ Ս. Մկրտչյանը հայտնել է, որ 2017 թվականի հոկտեմբերի 11-ին երկու տեսուչների հետ հակաթմրանյութային միջոցառման շրջանակներում ծառայություն իրականացնելիս Շիրակի մարզի համապատասխան պահակետում ստուգման նպատակով կանգնեցրել են Գազել մակնիշի ավտոմեքենան և զրուցել վարորդ Մ. Գևորգյանի հետ: Այդ ընթացքում իրենց է մոտեցել վարորդի եղբայրը` նույն պահակետում կայանված Միցուբիշի մակնիշի ավտոմեքենայի ուղևոր Ֆ. Գևորգյանը, ով հայհոյել է իրեն և ծառայակիցներին, փորձել ծեծի ենթարկել և սպառնացել, որ կսպանի:
Նյութերի նախապատրաստման ընթացքում Ֆ. Գևորգյանը, իր հերթին, հաղորդում է տվել այն մասին, որ վերը նշված երեք ոստիկաններից մեկը վիրավորել է իրեն, հետո վերցրել զենքը և սպառնացել, որ կկրակի: Բացի այդ, եղբորից՝ Մ. Գևորգյանից տեղեկացել է, որ ամրագոտին ամրացված չլինելու համար ոստիկանները նրանից 5000 ՀՀ դրամ կաշառք են պահանջել:
Ոստիկանության աշխատակցի կողմից Ֆ. Գևորգյանի ուղղությամբ զենք պահելու և կրակելու սպառնալիք տալու հանգամանքի մասին նույնաբովանդակ հաղորդումներ են տվել նաև Մ. Գևորգյանը և պահակետում կայանված Միցուբիշի մակնիշի ավտոմեքենայի վարորդը:
Դեպքի առթիվ ՀՀ քննչական կոմիտեի Շիրակի մարզային քննչական վարչությունում հարուցվել է քրեական գործ` ՀՀ քրեական օրենսգրքի 309-րդ հոդվածի 2-րդ մասով: Հաշվի առնելով, որ քրեական գործի նյութերում առկա են ՀՀ ոստիկանության պաշտոնատար անձանց կողմից կատարված` բռնությամբ զուգորդված պաշտոնեական լիազորություններն անցնելու առերևույթ հանցագործության հատկանիշներ, նշված քրեական գործն ըստ քննչական ենթակայության ընդունվել է ՀՀ հատուկ քննչական ծառայության քննիչի վարույթ` հետագա նախաքննությունը կատարելու համար:
Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
