Փաստաբանի նկատմամբ 100 հզր. դրամ սանկցիա կիրառելով` նրանց չեն կարող լռեցնել, դա խայտառակություն է. Լուսինե Սահակյան

Փաստաբանների նկատմամբ որպես դատական սանկցիա 100 հազար դրամ տուգանք կիրառելու մասին կետը, որը ներառված է նախագծում, խայտառակություն է:

Այս մասին Tert.am-ի հետ զրույցում ասաց փաստաբան Լուսինե Սահակյանը` անդրադառնալով ՀՀ դատական նոր օրենսգրքի նախագծով փաստաբանների նկատմամբ որպես դատական սանկցիա կարող է կիրառվել նաև տուգանքը՝ մինչև 100 հազար ՀՀ դրամի չափով կետին:

«Ես սա համարում եմ խայտառակություն։ Սա սկիզբ առավ նրանից, որ Փաստաբանների պալատի խորհրդի անդամներից մեկն ասում էր, որ արտերկրում գոյություն ունեն նորմեր, որոնցով փաստաբաններին նույնիսկ կարողանում են ազատությունից զրկել: Փաստաբանների պալատն` ի դեմս իր մարմինների, փոխարենն ամեն ինչ աներ, որ փաստաբանների համար շատ ավելի բարենպաստ պայմաններ ստեղծեին, իրավիճակը հասավ նրան, որ օրենսդրական լուրջ փոփոխություն է արվում: Փաստացի սա պալատի թուլացումն է, ու պալատի նախագահի այնպիսի գործունեության իրականացման արդյունքը, որով ամեն ինչ արվում է, որ իշխանությունների համար բարենպաստ պայմաններ ստեղծեն»,-ասաց փաստաբանը:  

Նրա խոսքով՝ փոփոխությունը կաշկանդելու է շատ փաստաբանների` նկատի ունենալով նաև այն հանգամանքը, որ դատարանները բազմաթիվ անօրինական սանկցիաներ են սկսում կիրառել, և դրան հետևում է ՓՊ-ի կարգապահական պալատի կարգապահական պատասխանատվության ենթարկելու որոշումը. «Հիմա արդեն պետությունն իր վրա է վերցրել այդ գործառույթը, որպեսզի դատարանն ուղիղ կարողանա գործիք ունենալ փաստաբանի դեմ: Սա  հանգեցնելու է շատ վատ հետևանքների»:
Սահակյանի խոսքով՝ փաստաբանները, ովքեր իրենց գործառույթն իրականացնելու են օրենքի սահմաններում և ամեն կերպ ցանկանում են պաշտպանել իրենց պաշտպանյալների  իրավունքները, այդ փաստաբաններին ոչ մի գործիքով պետությունը չի կարող կաշկանդել, անկախ նրանից, թե քանի անգամ քանի սանկցիա կարող են կիրառել:

«Բայց, նկատի ունենալով նաև վերջին զարգացումները, հասկանալի է, որ շատ-շատ փաստաբանների համար, ովքեր նույնիսկ վախենում են լքել դատարանի դահլիճը` կարգապահական պատասխանատվության չենթարկվելու համար, սա լուրջ գործոն է լինելու: Անկախ նրանից, թե ով ինչքան հղում կանի, թե այլ պետությունում նման օրենսդրական նորմեր գոյություն ունեն, մենք չպետք է մոռանանք, որ մենք ապրում ենք մի պետությունում, որտեղ դատարաները դեռ չեն հասել արտերկրում գործող դատարաններին, մեր երկրում անմեղ անձինք են դատապարտվում, և կան քաղբանտարկյալներ»:

Հարցին, թե փաստաբանները չեն կանխելու, որ նախագիծն օրենք չդառնա, Լուսինե Սահակյանն ասաց, որ տարիներ առաջ կարող էր խոսել միասնական պայքարի մասին,  բայց հիմա պայքարելու են անհատ փաստաբաններ. «Բայց քանի դեռ ՓՊ-ն այն իրավիճակում է, ինչ այսօր, ես չեմ հավատում, որ Պալատը կկարողանա իր գործառույթը կատարել, այդ դեպքում այլ պայքար կլիներ»:

Լուսինե Սահակյանն ասաց, որ անհատ փաստաբանները կպայքարեն այդ նախագծի դեմ և եթե անգամ այն ընդունվի ԱԺ-ի կողմից, ապա միևնույնն է, այն որոշ փաստաբանների չի կարող կաշկանդել. «Եթե իրենց թվում է, որ  դրանով կկարողանան լռեցնել, ապա այդպես չի լինելու»:
