Եթե Ընտանեկան բռնության կանխարգելման օրենքը թուլացվի, ապա աղմուկ կբարձրացնենք. իրավապաշտպան

Իրավապաշտպան Զարուհի Հովհաննիսյանը Tert.am-ի հետ զրույցում անդրադառնալով «Ընտանեկան բռնության կանխարգելման և ընտանեկան բռնության ենթարկված անձանց պաշտպանության մասին» օրենքի նախագծին, տեղեկացրեց, որ հանրային բուռն քննարկումից հետո առաջարկություններ են ներկայացվել Արդարադատության նախարարություն, որն այս պահին նորից աշխատում է առաջարկված փոփոխությունների վրա:
«Բայց եթե նախագիծը ոչ թե բարելավվի, այլ ընդհանրապես թուլացվի, արդեն քաղաքացիական հասարակության այն հատվածը, որը տարիներ շարունակ զբաղվել է այդ խնդրով՝ կանանց իրավունքների, երեխաների պաշտպանությամբ և բազմաթիվ առաջարկներ ներկայացրել՝ օրենքը դարձնելու մարդու իրավունքների, կանանց իրավունքների նկատմամբ ավելի զգայուն, եթե հետընթաց արձանագրվի, մենք ենք գնալու ընդառաջ, բավական աղմուկ ենք բարձրացնելու, որ պետությունը չի կատարում իր պարտավորությունները և այն խոցելի խմբերը, որոնք կարիքն ունեն նմանատիպ օրենսդրական կարգավորման, կմնան դարձյալ անպաշտպան»,-ասաց նա:
Հարցին, թե արդյոք նկատում են նման տրամադրություններ, որ իշխանությունները հետ են կանգնում օրենքից՝ վկայակոչելով հանրային ճնշումները, Զարուհի Հովհաննիսյանը պատասխանեց, թե սխալ է նախ մի խումբ մարդկանց կարծիքը ներկայացնել որպես անհամապատասխանեցում նախագծին և հանրային բողոք ներկայացնել:
«Երկրորդը՝ եթե որևէ տեղ խախտվում է մարդու իրավունքը, կյանքի իրավունքը՝ պետությունը պարտավոր է անպայման ընդունել նման օրենքներ, որպեսզի պաշտպանի այդ իրավունքը: Բայց եթե շրջվում է ու ասում, թե դեմ են, ապա դրանով պետության ներսում հանրային տրամադրությունն ու բռնությունն է արդարացնում»,-ասաց նա:
Ըստ Հովհաննիսյանի, դա ոչ միայն բռնության պատկերացումների խնդիր է, այլ միջազգային իրավունքների վավերացման հետ հակասության խնդիր է:
«Եթե դու վավերացրել ես Մարդու իրավունքների եվրոպական կոնվենցիան, եթե դու վավերացրել ես Կանանց հանդեպ խտրականության կոնվենցիան, եթե չես կատարում այդ կոնվենցիաների պահանջները և չես կատարում, Մարդու իրավունքների ռազմավարության 2014թ-ի ընդունած բոլոր պարտավորությունները, ուրեմն դու ինքդ խնդիր ունես քո կառավարվող էլիտայի մշակույթի պատկերացմամբ»,- ասաց նա:
Իրավապաշտպանը նշեց, որ նմանատիպ լայն հանրային բողոքների դեպքում նույնիսկ ՀՀԿ-ն չի վարանում և իրեն պետք եկած օրենքներն ընդունում է: «Բայց այս դեպքում իրենց մշակույթին դեմ օրենքն է, բռնության դեմ է, որի մշակույթը կրում է հենց իշխանությունը»,- ասաց նա:
