Պաշտոնեական դիրքը չարաշահելու կասկածանքով ձերբակալվել է անտառապահը

Սպիտակի անտառպետության թիվ 10-րդ պահաբաժնի տարածքում կատարված ապօրինի ծառահատումների դեպքի առթիվ ՀՀ քննչական կոմիետի Լոռու մարզային քննչական վարչության Սպիտակի քննչական բաժնի վարույթում քննվող քրեական գործով ձերբակալվել է անտառապահը: Այս մասին «Արմենպրես»-ին տեղեկացրին ՀՀ քննչական կոմիտեի դեպարտամենտի հասարակայնության հետ կապերի բաժնից:

2017 թվականի հոկտեմբերի 20-ին «Հայանտառ» ՊՈԱԿ-ի Գուգարքի անտառտնտեսության մասնաճյուղի աշխատակիցները Սպիտակի անտառպետության թիվ 10-րդ պահաբաժնում գտնվող պաշտպանական նշանակության արհեստական սոճուտի տարածքում հայտնաբերել են տարբեր տեսակի ծառերի ապօրինի հատման դեպք։

Անտառհատման հիշյալ դեպքով «Հայանտառ» ՊՈԱԿ-ի Գուգարքի անտառտնտեսության մասնաճյուղի աշխատակիցների կողմից կազմված թիվ 002202 անտառխախտման արձանագրության հիման վրա նախապատրաստված նյութերով տվյալներ են ձեռք բերվել այն մասին, որ 2017 թվականի հոկտեմբեր ամսին Սպիտակի անտառպետության թիվ 10-րդ պահաբաժնի տարածքում ապօրինի հատվել է 408 հատ տարբեր տեսակի ծառ։ 

Դեպքի առթիվ Լոռու մարզի դատախազությունում 2017 թվականի հոկտեմբերի 24-ին հարուցվել է քրեական գործ՝ ՀՀ քրեական օրենսգրքի 296-րդ հոդվածի 3-րդ մասով և 315-րդ հոդվածի 2-րդ մասով, որն ստացվել եւ վարույթ է ընդունվել ՀՀ քննչական կոմիտեի Լոռու մարզային քննչական վարչության Սպիտակի քննչական բաժնում:

Ձեռնարկված անհետաձգելի մեծածավալ քննչական գործողությունների արդյունքում պարզվել են մի շարք էական նշանակություն ունեցող հանգամանքներ, փաստական տվյալներ ձեռք բերվել, որ  Սպիտակի անտառպետության թիվ 10-րդ պահաբաժնի անտառապահը, պաշտոնեական դիրքը ծառայության շահերին հակառակ օգտագործելով չի կատարել իր ծառայողական պարտականությունները եւ թույլ է տվել, որպեսզի առանց համապատասխան թույլտվության հատվեն տարբեր տրամաչափի՝ սոճենի, հացենի, թեղի, բալենի, թղկի տեսակի թվով 408 ծառ: Ապա՝ ապօրինի ծառահատման փաստը թաքցնելու նպատակով հանձնարարել է հողով ծածկել ապօրինի հատված ծառերի կոճղերը: Նախնական հաշվարկներով պատճառված նյութական վնասը կազմում է 25.444.500 ՀՀ դրամ:

Անտառապահը հոկտեմբերի 29-ին  ձերբակալվել է՝ ՀՀ քրեական օրենսգրքի 308-րդ հոդվածի 2-րդ մասով նախատեսված  արարք կատարելու կասկածանքով:

Քրեական գործի նախաքննությունը շարունակվում է: Իրականացվում են ակտիվ քննչական գործողություններ՝ ապօրինի ծառահատումներին հնարավոր առնչություն ունեցող անձանց ամբողջական շրջանակը պարզելու ուղղությամբ։

Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
