Սպիտակի անտառպետությունից ծառերի ապօրինի հատման առթիվ հարուցված քրգործով անտառապետին ձերբակալելու որոշում է կայացվել

ՀՀ Լոռու մարզի դատախազությունում որոշում է կայացվել ձերբակալել «Հայանտառ» ՊՈԱԿ-ի «Գուգարքի անտառտնտեսություն» մասնաճյուղի Սպիտակի անտառպետության անտառապետին: Այս մասին «Արմենպրես»-ին տեղեկացրին ՀՀ դատախազության հանրային կապերի բաժնից:
Լոռու մարզի դատախազությունում հոկտեմբերի 24-ին Սպիտակի անտառպետության տարածքում ապօրինի ծառահատում կատարելու դեպքի առթիվ ՀՀ քրեական օրենսգրքի 296-րդ հոդվածի 3-րդ մասով և 315-րդ հոդվածի 2-րդ մասով հարուցվել է քրեական գործ, որի նախաքննությունը հանձնարարվել է ՀՀ քննչական կոմիտեի Լոռու մարզային քննչական վարչությանը:
Ըստ նախապատրաստված նյութերի՝ ինքնությունը չպարզված անձանց կողմից «Հայանտառ» ՊՈԱԿ-ի «Գուգարքի անտառտնտեսություն» մասնաճյուղի Սպիտակի անտառպետության թիվ 10-րդ պահաբաժնի տարածքում ապօրինի հատվել են 408 հատ տարբեր տեսակի ծառեր, որի հետևանքով պետությանը և շրջակա միջավայրին պատճառվել է առանձնապես խոշոր՝ 25.444.500 ՀՀ դրամի վնաս:
Նախաքննության ընթացքում ձեռնարկված օպերատիվ-հետախուզական և քննչական մեծածավալ գործողությունների արդյունքում ձեռք են բերվել փաստական տվյալներ այն մասին, որ Սպիտակի անտառպետության տարածքում ծառերի ապօրինի հատումը կատարվել է նույն անտառտնտեսության անտառային պետական ծառայություն իրականացնող իրավասու պաշտոնատար անձանց անմիջական թողտվությամբ:
Արդյունքում հոկտեմբերի 29-ին պաշտոնեական լիազորությունները չարաշահելու կասկածանքով ձերբակալվել էր տվյալ անտառպետության անտառապահը, որին նախաքննությամբ ձեռք բերված բավարար ապացույցների համակցությամբ հոկտեմբերի 31-ին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 308-րդ հոդվածի 2-րդ մասով:
Իրականացված քննչական գործողությունների արդյունքում տվյալներ են ձեռք բերվել այն մասին, որ նույն պահաբաժնում 408 հատ ծառերի ապօրինի հատումը կատարվել է անտառապետի անմիջական թողտվության արդյունքում:
Նկատի ունենալով այդ հանգամանքը, ինչպես նաև այն, որ անտառապետի գտնվելու վայրը հայտնի չէ, ՀՀ Լոռու մարզի դատախազությունում կայացվել է վերջինիս ձերբակալելու որոշում: Կատարումն ապահովելու համար որոշումն ուղարկվել է ՀՀ ոստիկանության Լոռու մարզային վարչության Սպիտակի բաժին՝ հանձնարարելով արդյունքների մասին անհապաղ տեղեկացնել Լոռու մարզի դատախազությանը և վարույթն իրականացնող մարմնին:
Բացի այդ պարզվել է նաև այն անձի ինքնությունը, ում ցուցումով կատարվել են ապօրինի ծառահատումները: Հոկտեմբերի 31-ին որոշում է կայացվել վերջինիս ՀՀ քր. օրենսգրքի 296-րդ հոդվածի 3-որդ մասով որպես մեղադրյալ ներգրավվելու մասին: Նրա նկատմամբ խափանման միջոց է ընտրվել կալանավորումը և հայտարարվել հետախուզում:
Նախաքննությունը շարունակվում է: Ձեռնարկվում են ակտիվ օպերատիվ-հետախուզական և քննչական համագործակցված միջոցառումներ՝ «Հայանտառ» ՊՈԱԿ-ի «Գուգարքի անտառտնտեսություն» մասնաճյուղի Սպիտակի անտառպետության տարածքում ապօրինի այս ծառահատումների հետ առնչություն ուենցող անձանց ամբողջական շրջանակը պարզելու ուղղությամբ:
Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով։
