Տուգանք պատժատեսակի կատարման ՀՀ դատախազության նախաձեռնությունն արդյունքներ է տալիս

ՀՀ Սահմանադրական դատարանը 2013 թվականի ապրիլի 23-ին ընդունած որոշմամբ ՀՀ Սահմանադրությանը հակասող և անվավեր էր ճանաչել ՀՀ քրեական օրենսգրքի 51-րդ հոդվածի 4-րդ մասն այնքանով, որքանով տուգանքը կամ տուգանքի չվճարված մասը հանրային աշխատանքներ պատժատեսակով փոխարինելու համար կատարված հաշվարկի արդյունքում համարժեքորեն չէր երաշխավորվում երկու հարյուր յոթանասուն ժամից պակաս տևողությամբ հանրային աշխատանքների կիրառման իրավական հնարավորություն այն անձանց նկատմամբ, որոնք չունեն տուգանքը վճարելու հնարավորություն, ինչով արգելափակվում էր նրանց իրավական պաշտպանության արդյունավետ միջոցի իրավունքի իրացումը, ինչպես նաև տարբերակում չէր դրվում տուգանքը վճարելու անհնարինության և դրանից խուսափելու հանգամանքների միջև: Այս մասին «Արմենպրես»-ին տեղեկացրին ՀՀ դատախազության հանրային կապերի բաժնից:
2016թ. ՀՀ դատախազությունն ուսումնասիրություն էր կատարել ազատազրկման հետ չկապված պատժատեսակների գործնականում կիրառման ոլորտում և, ի թիվս այլ խնդիրների, պարզել, որ ՍԴ մատնանշած որոշման հանգամանքներով պայմանավորված՝ տուգանք պատժատեսակի կատարումը գործնականում դարձել է անհնարին, քանի որ կամովին տուգանքը չվճարելու դեպքում այդ պատժատեսակի կատարումն ապահովելու մեխանիզմներ գոյություն չունեին: Նշված իրավիճակը հանգեցրել էր նրան, որ դատապարտյալների կողմից տուգանքը կամովին չէր վճարվում, այսինքն, ըստ էության, դատական ակտերը չէին կատարվում:
Ելնելով դրանից՝ ՀՀ գլխավոր դատախազի կողմից ՀՀ արդարադատության նախարարություն էր ներկայացվել ՀՀ քրեական օրենսգրքի 51-րդ և 54-րդ հոդվածներում փոփոխություններ կատարելու մասին ՀՀ օրենքի նախագիծ՝ ինչպես տուգանք, այնպես էլ հանրային աշխատանքներ պատիժների նպատակների և պատժի անխուսափելիության սկզբունքի հստակ ապահովման նպատակով:
Այս գործընթացի արդյունքում ՀՀ Ազգային ժողովի կողմից 2017թ. մարտի մեկին ընդունվեց ՀՀ քրեական օրենսգրքում փոփոխություններ և լրացումներ կատարելու մասին համապատասխան օրենքը: Դրանով հստակեցվեցին դատապարտյալների կողմից տուգանքը վճարելու անհնարինության և տուգանքը վճարելուց չարամտորեն խուսափելու դեպքերի իրավական հետևանքները՝ տուգանքը հանրային աշխատանքներով փոխարինելու իրավակարգավորումները: Հստակեցվեցին նաև հանրային աշխատանքներ պատժատեսակի կիրառման ընթացակարգերը:
Դրանից անմիջապես հետո ՀՀ դատախազության կողմից ուժեղացվեց հսկողությունը վերը նշված գործընթացների, այդ թվում՝ հանրային աշխատանքներ պատժատեսակի գործնական կիրառման նկատմամբ: ՀՀ ԱՆ պրոբացիոն պետական ծառայության մարմինների գործունեության շրջանակներում ՀՀ դատախազության ստորաբաժանումների կողմից ուժեղացվել է հսկողությունը համապատասխան դատապարտյալների պատժի կատարման օրինականության նկատմամբ: Փաստացի ապահովվել է օրենսդրական փոփոխությունների կենսագործումը, որը գործնականում դրական արդյունքներ է ապահովել:
Մասնավորապես՝ ՀՀ ԱՆ պրոբացիայի պետական ծառայության ստորաբաժանումների կողմից օրենքում կատարված վերոնշյալ փոփոխության՝ ուժի մեջ մտնելուց հետո թվով 867 միջնորդություն է ներկայացվել ընդհանուր իրավասության առաջին ատյանի դատարաններ՝ դատավճռով նշանակված տուգանք պատժատեսակը հանրային աշխատանքներ պատժատեսակով փոխարինելու վերաբերյալ: Արդյունքում տուգանք պատժատեսակի դատապարտված դատապարտյալների կողմից կատարվել է 183 365 300 ՀՀ դրամ գումարի վճարում:
