Հելսինկյան Քաղաքացիական Ասամբլեայի Վանաձորի գրասենյակի փոխանցմամբ, 2017 թ․ նոյեմբերի 6-ին ՀՀ Վարչական դատարանում սկսվեց ՀՀ ԱՍՀՆ Բժշկասոցիալական փորձաքննության գործակալության դեմ  Ս. Գ.-ի հայցի քննությունը։

2009 թ.-ից 3-րդ խմբի հաշմանդամություն ունեցող անձ համարվող Ս. Գ.-ին ՀՀ Բժշկասոցիալական փորձաքննության գործակալությունը վերադասության կարգով վերափորձաքննության արդյունքում 2017 թ. մայիսի 16-ի որոշմամբ հաշմանդամություն ունեցող անձ չի ճանաչել:

Մինչ այդ՝ 2017 թ. մարտի 27-ին, հերթական վերափորձաքննության ժամանակ Ս. Գ.-ն ճանաչվել էր անժամկետ երրորդ կարգի հաշմանդամություն ունեցող անձ: Դատարան ներկայացված հայցով Ս․ Գրիգորյանը պահանջել է վերացնել գործակալության 2017 թվականի մայիսի 16-ի որոշումը: Նոյեմբերի 6-ին կայացած դատական նիստին ներկայացել էին հայցվոր Ս. Գ.-ն ու վերջինիս ներկայացուցիչ, ՀՔԱ Վանաձորի գրասենյակի Երևանի ներկայացուցչության իրավաբան Տաթևիկ Սիրադեղյանը, ինչպես նաև պատասխանողի ներկայացուցիչներ Բելլա Հովհաննիսյանն ու Մարիամ Երիցյանը։

Հայցվորի ներկայացուցիչ Տ. Սիրադեղյանը ներկայացրեց հայցի առարկան ու հիմքերը։ Նշեց, որ բժշկասոցիալական փորձաքննության գործում առկա բժշկական փաստաթղթերի առկայության պայմաններում Ս. Գ.-ը պետք է ճանաչվեր անժամկետ երրորդ խմբի հաշմանդամություն ունեցող անձ, իսկ նրա վերափորձաքննության իրականացումը չի բխել օրենսդրության պահանջներից: Պատասխանող կողմը ներկայացրեց իր դիրքորոշումը հայցի դեմ՝ նշելով, որ վերափորձաքննության արդյունքում հայցվորի մոտ հայտնաբերված հիվանդության ֆունկցիայի աննշան խանգարումը չի հանգեցրել կենսագործունեության որևէ սահմանափակման, ուստի՝ հաշմանդամություն սահմանելու հիմքեր չեն եղել։ Դատարանն ու հայցվոր կողմը փորձեցին պարզել, թե ինչ հիմքով է հայցվորի նկատմամբ կայացված անժամկետ երրորդ խմբի հաշմանդամ ճանաչելու մասին որոշումը վերացվել:

Դրան ի պատասխան՝ գործակալության ներկայացուցիչները հայտնեցին, որ հայցվորի էպիկրիզի օբյեկտիվ զննման նկարագրությունը չի համապատասխանել ախտորոշմանը։ Այնուհետև հայցվորի ներկայացուցիչը հայցի հիմքերի, առարկայի և կիրառման ենթակա իրավական ակտերի շրջանակի վերաբերյալ հարցեր ուղղեց պատասխանող կողմին։ Աշխատանքային օրվա ավարտի պատճառով նախնական դատական նիստը հետաձգվեց և նշանակվեց 2018 թ․ մարտի 6-ին՝ ժամը 11։00-ին։
