Հայաստանում նախատեսվում է կարգավորել պատիժները կատարող մարմինների դեմ բողոքարկման ընթացակարգը

Արդարադատության նախարարությունը նախատեսում է կարգավորել պատիժները կատարող մարմինների և հիմնարկների պաշտոնատար անձանց գործողության, անգործության կամ ընդունած ակտի վերադասության կարգով բողոքարկման ընթացակարգը: «Արմենպրես»-ի հարցմանն ի պատասխան` ՀՀ արդարադատության նախարարության աշխատակազմի ղեկավարի տեղակալ Արմեն Գևորգյանը նշել է, որ նախագծի մշակումը պայմանավորված է նրանով, որ ՀՀ քրեակատարողական օրենսգրքի 7-րդ հոդվածը, կարգավորելով պատիժները կատարող մարմինների և հիմնարկների պաշտոնատար անձանց գործողությունների բողոքարկման հարցը, չի հստակեցնում, թե բողոքները որ դատարանին պետք է ընդդատյա լինեն:
«Միաժամանակ, օրենսդրությամբ չի ապահովվում որոշակիությունը և դատապարտյալի համար իր իրավունքների պաշտպանության կանխատեսելիությունը:
ՀՀ օրենսդրության վերլուծությունը վկայում է, որ պատիժները կատարող մարմինների և այլն մարմինների բողոքարկման ընթացակարգի հետ կապված հարցերի համապարփակ իրավական կարգավորումը բացակայում է, ինչն իր հերթին խնդիրներ է առաջացնում վերոհիշյալ որոշումների բողոքարկման ընթացակարգում»,- նշել է Գևորգյանը:
Նախագիծը նաև համապարփակ կարգավորում է բողոքարկման ժամկետները, բողոքի քննարկման կարգը և արդյունքները:
Անդրադառնալով դատապարտյալի կողմից պատիժները կատարողի դեմ բողոքարկման իրավունքի կարգավորմանը` Գևորգյանը նշել է, որ նախագծի համաձայն` դատապարտյալը պատիժները կատարող մարմինների և հիմնարկների պաշտոնատար անձանց դեմ բողոքը կարող է ներկայացնել ՀՀ արդարադատության նախարարության քրեակատարողական հիմնարկի պետին, ՀՀ արդարադատության նախարարության քրեակատարողական վարչության պետին կամ ՀՀ արդարադատության նախարարին:
«Եթե բողոքը միաժամանակ ներկայացվում է ակտն ընդունած մարմնին և (կամ) այդ մարմնի վերադաս մարմնին, ապա բողոքը ենթակա է քննարկման վերադաս մարմնի կողմից: Ակտն ընդունած մարմնի կողմից բողոքի քննարկման արդյունքում ընդունած ակտը կարող է բողոքարկվել վերադաս մարմին»,- ասել է Գևորգյանը:
