Բազմակողմանի, լրիվ և օբյեկտիվ քննության նպատակով ՀՀ գլխավոր դատախազի կողմից Հատուկ քննչական ծառայության վարույթ ընդունված` առողջությանը ծանր վնաս պատճառելու փաստով հարուցված քրեական գործի նախաքննության ընթացքում տվյալներ են ձեռք բերվել ՀՀ ԱՆ «Հրազդան» քրեակատարողական հիմնարկի պաշտոնատար անձանց կողմից պաշտոնեական դիրքը չարաշահելու առերևույթ հանցագործության դեպքի վերաբերյալ:

ՀՔԾ մամուլի ծառայության հաղորդմամբ, այսպես, քրեական գործի նյութերով պարզվել է, որ 25.06.2017թ.-ին «Հրազդան» ՔԿՀ-ում վիճաբանություն է տեղի ունեցել նույն հիմնարկում պատիժ կրող դատապարտյալ Գ. Արսենյանի և այլ դատապարտյալների միջև: Վիճաբանությունը վերաճել է ծեծկռտուքի, որի հետևանքով Գ. Արսենյանը կյանքի համար վտանգավոր ծանր մարմնական վնասվածքներով տեղափոխվել է հիվանդանոց:

ՀՀ հատուկ քննչական ծառայությունում կատարված հետագա նախաքննության ընթացքում պարզվել է, որ տուժած դատապարտյալը պարբերաբար թղթախաղով զբաղվելու առաջարկներ է ստացել իր խցակցի կողմից, սակայն հրաժարվել է և պահանջել չանհանգստացնել իրեն: Պատիժ կրելու ընթացքում դատապարտյալն իրեն այլ խուց տեղափոխելու վերաբերյալ գրավոր դիմում է ներկայացրել ՔԿՀ-ի ղեկավարությանը, սակայն դրան սահմանված կարգով ընթացք տալու փոխարեն իրեն հարկադրել են շարունակել պատիժը կրել նույն խցում: 25.06.2017թ.-ին հերթական անգամ գումարի դիմաց թղթախաղով զբաղվելու` խցակցի առաջարկը մերժելը վերածվել է վիճաբանության և քաշքշուկի, որին միջամտել է անարգել մեկ այլ խցից դուրս եկած, դատապարտյալների շրջանում հեղինակություն վայելող մեկ ուրիշ դատապարտյալ, ով ՔԿՀ-ի աշխատակիցների թողտվությամբ, պարզաբանումներ կատարելու պատրվակով Գ. Արսենյանին տեղափոխել է իր խուց: Այնտեղ մի քանի դատապարտյալ, այդ թվում` Գ. Արսենյանի խցակիցը ծեծի են ենթարկել նրան` վերջինիս պատճառելով ծանր մարմնական վնասվածքներ: Տուժած դատապարտյալ հայտնել է, որ քրեակատարողական հիմնարկի աշխատակիցները հնարավորություն են ունեցել կանխելու ծանր հանցագործությունը, սակայն նրանք անտեսել են այլ խուց տեղափոխվելու իր խնդրանքը, իսկ դեպքի օրը չեն կատարել ծառայողական պարտականությունները, որի հետևանքով իր առողջությանը պատճառվել է ծանր վնաս: Այսպիսով, «Հրազդան» ՔԿՀ-ի պետական հատուկ ծառայություն իրականացնող պաշտոնատար անձանց կողմից պաշտոնեական լիազորությունները չարաշահելու ենթադրյալ հանցագործության դեպքի առթիվ հարուցվել է քրեական գործ` ՀՀ քրեական օրենսգրքի 308-րդ հոդվածի 1-ին մասի հատկանիշներով: Կատարվում է նախաքննություն:

Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
