Եվս երկու քրգործ` պաշտոնատար անձանց կողմից պաշտոնեական դիրքը չարաշահելու վերաբերյալ

ՀՀ հատուկ քննչական ծառայության վարույթ է ընդունվել ՀՀ ոստիկանության եւ ՀՀ քննչական կոմիտեի պետական հատուկ ծառայություն իրականացնող պաշտոնատար անձանց կողմից պաշտոնեական լիազորությունները չարաշահելու առերեւույթ հանցագործության դեպքերի առթիվ ՀՀ գլխավոր դատախազությունում հարուցված եւս երկու քրեական գործ:
Այսպես, քրեական գործերից մեկի նյութերի համաձայն, ՀՀ Արմավիրի մարզի ընդհանուր իրավասության առաջին ատյանի դատարանի կողմից կայացված որոշմամբ ՀՀ քրեական օրենսգրքի 205-րդ հոդվածի 1-ին մասով մեղադրվող ամբաստանյալ Հ. Գրիգորյանի նկատմամբ որպես խափանման միջոց է ընտրվել կալանավորումը եւ հայտարարվել հետախուզում: Նշված որոշման հիման վրա ՀՀ ոստիկանության Արմավիրի մարզային վարչության Վաղարշապատի բաժնում կազմվել է հետախուզական գործ:
Նույն քաղաքացու վերաբերյալ ՀՀ ԿԱ պետական եկամուտների կոմիտեի քննչական վարչությունում քննվող մեկ այլ քրեական գործով 15.12.2011թ.-ին որոշում է կայացվել Հ. Գրիգորյանի նկատմամբ հետախուզում հայտարարելու մասին, իսկ որոշումը ուղարկվել է ոստիկանության Արմավիրի մարզային վարչության Վաղարշապատի բաժին:
Արմավիրի մարզի ընդհանուր իրավասության առաջին ատյանի դատարանի 18.07.2014թ.-ի որոշմամբ հանցագործությամբ պատճառված վնասը եւ հաշվարկված տույժերն ու տուգանքները հատուցելու հիմքով քրեական գործով վարույթը կարճվել է: Նշված որոշման հիման վրա ոստիկանության Վաղարշապատի բաժնի կողմից մեղադրյալի նկատմամբ հետախուզումը դադարեցվել է, մինչդեռ վերջինս, ինչպես արդեն նշվել է, հետախուզվող է հանդիսացել ՀՀ ԿԱ պետական եկամուտների կոմիտեի քննչական վարչության քննիչի վարույթում գտնվող քրեական գործով: Արդյունքում, նշված քրեական գործով Հ. Գրիգորյանի նկատմամբ փաստացի հետախուզում չի իրականացվել:
Մյուս քրեական գործի նյութերով պարզվել է, որ 07.04.2009թ.-ին ՀՀ ոստիկանության քննչական գլխավոր վարչության Կոտայքի մարզի քննչական բաժնի Աբովյանի քննչական բաժանմունքում հարուցված քրեական գործով մեղադրյալ Խ. Հայրաբիդյանի նկատմամբ որպես խափանման միջոց է ընտրվել կալանավորումը եւ հայտարարվել հետախուզում: Հետախուզում հայտարարելու որոշման հիման վրա ՀՀ ոստիկանության Կոտայքի մարզային վարչության Կոտայքի բաժնում կազմվել է հետախուզական գործ:
2015թ.-ի ընթացքում ՀՀ ոստիկանության Ինտերպոլի ԱԿԲ-ի կողմից վարույթն իրականացնող մարմնից` ՀՀ քննչական կոմիտեի Աբովյանի քննչական բաժնից բազմիցս պահանջվել է ներկայացնել մեղադրյալի վերաբերյալ պարսկերեն լեզվով փաստաթղթեր, նկատի ունենալով, որ պարզվել է հետախուզվողի գտնվելու վայրը: Սակայն համապատասխան պաշտոնատար անձանց կողմից նշված փաստաթղթերն այդպես էլ չեն ներկայացվել, որի պատճառով հնարավոր չի եղել կազմակերպել հետախուզվողի տեղափոխումը ՀՀ, եւ վերջինիս հանձնելու վերաբերյալ գործը ԻԻՀ-ում փակվել է:
Հիշյալ դեպքերի առթիվ ՀՀ գլխավոր դատախազությունում ՀՀ քրեական օրենսգրքի 308-րդ հոդվածի 1-ին մասով հարուցված քրեական գործերը քննչական ենթակայության կարգով ընդունվել են ՀՀ հատուկ քննչական ծառայության վարույթ` հետագա նախաքննությունը կատարելու համար:
