ՀՀ քննչական կոմիտեից հայտնում են, որ հատկապես կարևոր գործերի քննության գլխավոր վարչությունում պարզվում են մի շարք կայքերի կողմից հեռուստաընկերության հեղինակային և հարակից իրավունքները խախտելու դեպքի հանգամանքները: Ձեռք բերված ապացույցների հիման վրա՝ մեղադրանք է առաջադրվել մեկ անձի:

«Շանթ» ՍՊ ընկերության տնօրենի կողմից 2016 թվականի մայիսին հաղորդում էր ստացվել առ այն, որ մի շարք համացանցային կայքերի միջոցով ուղիղ հեռարձակվում է «Շանթ» հեռուստաալիքը, տեղադրվում հեռուստաընկերության արտադրած հեռուստածրագրերը՝ այդպիսով խախտելով իրենց  հեղինակային և հարակից իրավունքները:

Դեպքի առթիվ հարուցվել է քրեական գործ՝ ՀՀ քրեական օրենսգրքի 158-րդ հոդվածի 1-ին մասով, որով նախաքննությունն իրականացվում է ՀՀ ՔԿ հատկապես կարևոր գործերի քննության գլխավոր վարչությունում:

Փաստական տվյալներ են ձեռք բերվել, որ ավելի քան 20 կայքերի միջոցով հեռարձակվում են հեռուստահաղորդումները՝ առանց հեղինակի թույլտվության, տարածվում նրանց կողմից պատրաստված հաղորդումները։ Իրականացվել են մեծածավալ քննչական և դատավարական այլ գործողություններ՝ կայքերի սեփականատերերին հայտնաբերելու ուղղությամբ:

Պարզվել է, որ կայքերի մի մասը ստեղծվել է Ռուսաստանի Դաշնությունում գտնվող, մի մասը՝ Ամերիկայի Միացյալ Նահանգներում, Ավստրալիայում, իսկ մեկը՝ Ուկրաինայում գտնվող սերվերային կայքերի միջոցով:

Քրեական գործի շրջանակներում դատարանից թույլտվություն է ստացվել` դիտարկվող կայքերը ստեղծած և հասանելիություն ստացած IP հասցեները ստանալու վերաբերյալ, որոնց հիման վրա՝ իրավական օգնություն ցուցաբերելու մասին հարցումներ են ուղարկվել նշված երկրների իրավասու մարմիններին:

Ռուսաստանի Դաշնությունից ստացվել են հարցմամբ պահանջված տեղեկությունները, որի համաձայն` համացանցային կայքերից մեկը՝ www.arm-film.ru, գրանցված է Երևանի բնակչի անվամբ, պարզվել, որ նշված կայքը հասանելիություն են ստանում ՀՀ-ում գտնվող պրովայդերների IP հասցեներից:

Ձեռնարկված քննչական և դատավարական գործողությունների արդյունքում բավարար ապացույցներ են ձեռք բերվել, որ կայքի սեփականատերը, ով Երևանի բնակիչ է՝ ծնված 1988թ., ամիսներ շարունակ, շահույթ ստանալու նպատակով, ապօրինի օգտագործել է հեռուստաընկերության հեղինակային իրավունքի օբյեկտ հանդիսացող երկու հեռուստասերիալի  սերիաները՝ դրանք տեղադրելով և տարածելով համացանցային կայքում՝ առանց ընկերության համաձայնության՝ այդպիսով պատճառելով խոշոր չափի գույքային վնաս:

Նախաքննության ընթացքում ՍՊ ընկերությունը ճանաչվել է տուժող, 29-ամյա տղամարդուն մեղադրանք է առաջադրվել՝ ՀՀ քրեական օրենսգրքի ՀՀ քրեական օրենսգրքի 158-րդ հոդվածի 2-րդ մասի 5-րդ կետով:

Քրեական գործի նախաքննությունը շարունակվում է, ձեռնարկվում են անհրաժեշտ միջոցառումներ՝ համացանցային մյուս կայքերի սեփականատերերին հայտնաբերելու, նրանց գործողություններին համապատասխան քրեաիրավական գնահատական տալու ուղղությամբ:
