Մուկուչյանի պատասխանը ուսումնական ձեռնարկի թեմա
POLITICSPast.am-ը տեղեկացնում է.Իրականում ողջ աշխարհում ընդունված նորմ է, որ օրենքները պետք է ենթարկվեն իրավունքին, բայց պարզվում է, որ մեզ մոտ ճիշտ հակառակն է: Հիմա մեր երկրում ստեղծվել է մի իրավիճակ, որ թեև բոլորս ապրում և գործում ենք հին Սահմանադրության օրոք, ունենք նաև նոր Սահմանադրություն, բայց չգիտես ինչու դրանցից ոչ մեկն էլ չի գործում:
Այլ կերպ ասած` բոլորս ապրում ենք վիրտուալ Հայաստանում, որտեղ տեսականորեն ամեն ինչ կա, բայց ոչ մի բանի համար էլ պիտանի չէ: Ավելի աբսուրդային իրավիճակ պատկերացնել հնարավոր չէ, երբ որևէ երկիր ունի երկու բարձրագույն օրենքի «մասին» երկու փաստաթուղթ, բայց դրանցից ոչ մեկն էլ օրինական ուժ չունի: Եվ սա պարզվեց այն օրը, երբ ԱԻՄ առաջնորդ Պարույր Հայրիկյանը որոշեց երկրում Սահմանադրական բարեփոխումներ իրականացնելու հանրաքվեի նախապատրաստվել:
ԿԸՀ ղեկավար Տիգրան Մուկուչյանն այս էլ երկրորդ անգամ Պ. Հայրիկյանին գրավոր տեղեկացնում է, որ սահմանադրական փոփոխություններ նախաձեռնելու համար 200 հազար ստորագրություն հավաքելու ինստիտուտն ուժի մեջ է մտնելու 2018 թվականի ապրիլից, երբ նոր նախագահի լիազորությունները ուժի մեջ մտնեն։ Իսկ մինչ այդ, ո՛չ 200 հազար ստորագրություն հավաքելու ձևաթուղթ կարող է լինել, ոչ էլ հնարավոր է նմանօրինակ որևէ նախաձեռնություն իրականացվել, քանի որ գործողով կուսակցությունը այս հարցով իրավունք չունի հանրաքվեի պահանջով դիմել ՍԴ:
Ասել է, թե հիմա ողջ երկիրը գտնվում է հարկադիր պարապուրդի մեջ, այսինքն՝ ընդունված օրենքները՝ օրենքներ չեն, ընդունված որոշումները՝ որոշումներ չեն, ԿԸՀ–ն՝ ԿԸՀ չէ և այդպես շարունակ: Եվ չի բացառվում, որ 2018–ի ապրիլին էլ հանկարծ պարզվի, որ նախորդ և հաջորդ Սահմանադրությունների արանքում ապրած ժամանակահատվածը պետք է «դուրս» գրել ու աղբամանը նետել, քանի որ այն մի տեսակ միջանկյալ բնույթ է ունեցել և հակասում է «տիեզերքի» օրենքներին: Այսինքն, ստացվում է, որ մեր երկրում ոչ թե օրենքն է ենթարկվում իրավունքին, այլ իրավունքը՝ օրենքներին: Ասել է, թե, սա տարիներ առաջ շրջանառվող՝ օրենքը ես եմ թեզի շարունակությունն է, որը հանգիստ տեղավորվում է իրավունքը Տ. Մուկուչյանն է «գաղափարախոսության» տիրույթում, քանի որ նա է «սահմանում», թե այս օրերին քաղաքական հարցերի մասով ով ինչ կարող է կամ չի կարող կազմակերպել ու իրականացնել:
Նման դիմում–պատասխաններն անշուշտ կարևոր են, հետագայում ուսումնական ձեռնարկներ գրելու և հիմնավորելու համար, թե ցանկության դեպքում ինչեր կարող է գրել ու ինչքան հեռու կարող է գնալ իշխանության սպասարկուների երևակայությունը, արհամարհելով ողջ երկրի ազգաբնակչության իրավունքները:
