Կառավարությունում քննարկվել է դատարանների բեռնաթափմանը միտված օրենսդրական փաթեթը

ՀՀ վարչապետ Կարեն Կարապետյանի մոտ նոյեմբերի 27-ին տեղի է ունեցել խորհրդակցություն, որի ընթացքում քննարկվել են դատարանների բեռնաթափման, դատական գործերի բաշխման, որոշ գործերի պարզեցված վարույթի քննության և նիստերի հետաձգման խնդիրների լուծմանն ուղղված միջոցառումներն ու քայլերը:

Ինչպես «Արմենպրես»-ին տեղեկացրին ՀՀ կառավարության տեղեկատվության և հասարակայնության հետ կապերի վարչությունից, զեկուցվել է, որ ՀՀ արդարադատության նախարարությունը, ի կատարումն ՀՀ վարչապետի հանձնարարականի,  մշակել է Դատական օրենսգրքում, Քաղաքացիական դատավարության օրենսգրքում փոփոխությունների օրենսդրական փաթեթ: Դրանով, մասնավորապես, առաջարկվում է նվազեցնել դատարանների նախագահներին մակագրվող գործերի քանակի սահմանաչափը` դարձնելով մինչև տասը տոկոս, բացառությամբ Երևան քաղաքի ընդհանուր իրավասության դատարանի նախագահի: Նշվել է, որ դրանով կլուծվեն գործերի բաշխման, դատավորների միջև ծանրաբեռնվածության անհամաչափության խնդիրները: Առաջարկվող փոփոխություններով նախատեսվում է դատական նիստերի հետաձգման մասով օրենսգրքում հստակ ձևակերպել, որ նման որոշումները պետք է լինեն բացառապես պատճառաբանված, մինչև երկու միլիոն դրամ գումարի բռնագանձման հայցապահանջներով նախատեսվել է գործերի քննության պարզեցված ընթացակարգ:

Միաժամանակ, որպես արտադատական միջոց առաջարկվել է էլեկտրոնային կառավարման համակարգի միջոցով էլեկտրոնային կապ ստեղծել նոտարների, բանկային և վարկային կազմակերպությունների միջև` նոտարին տրամադրելով էլեկտրոնային կնիք, էլեկտրոնային թվային ստորագրություն:

Օրենսդրական փաթեթով սահմանվել է, որ Երևան քաղաքում գործելու է մեկ ընդհանուր իրավասության դատարան իր նստավայրերով: Զեկուցվել է, որ դրանով ավելանալու է փաստացի գործեր քննող դատավորների թվաքանակը, բարձրացվելու է դատարանների կառավարման արդյունավետությունը,  իրականացվելու է բյուջետային միջոցների օպտիմալացում։

Խորհրդակցության ընթացքում քննարկվել է նաև Վարչական վերաքննիչ դատարանի դատավորների քանակի ավելացման, ինչպես նաև վարչական գործերի վերադասության կարգով բողոքարկման արդյունավետության բարձրացման հարցերը:

Վարչապետ Կարեն Կարապետյանը կարևորել և ողջունել է ներկայացված օրենսդրական փաթեթը և հանձնարարել որոշ տեխնիկական խնդիրների կարգավորումից հետո այն ներկայացնել կառավարության աշխատակազմ:
