Ավետիսյանների ընտանիքի սպանության գործով երկորդ դիմումը՝ ՍԴ-ում. «Հայկական ժամանակ»

«Գյումրիում Ավետիսյանների ընտանիքի սպանության գործով տուժող կողմի իրավահաջորդները երկրորդ դիմումն են ներկայացրել Սահմանադրական դատարան:

Այս դիմումով դիմումատուները վիճարկում են ՀՀ քրեական դատավարության օրենսգրքի այն նորմերը, որոնց հիման վրա դիմումատուները զրկվել են ոչ նյութական վնասի փոխհատուցման պահանջ ներկայացնելու հնարավորությունից:

Դիմումն արդեն իսկ ՍԴ-ն վարույթ է ընդունել և նշանակել առաջին դատական նիստը, որը տեղի կունենա 2018 թվականի մարտի 13-ին՝ ժամը 10:00-ին: Սույն գործով պատասխանող կողմում դատավարությանը ներգրավվել է ՀՀ քրեական դատավարության օրենսգիրքն ընդունած մարմինը` ՀՀ Ազգային ժողովին: Այս մասին մեր զրույցում ասաց տուժողների իրավահաջորդների ներկայացուցիչ Արամազդ Կիվիրյանը:

Հիշեցնենք, որ Շիրակի մարզի ընդհանուր իրավասության դատարանը հրաժարվել էր վարույթ ընդունել Ռուսաստանի Դաշնության դեմ ոչ նյութական վնասի փոխհատուցման վերաբերյալ ներկայացված քաղաքացիական հայցը։ Առաջին դիմումով, որը տուժող կողմի իրավահաջորդները ներկայացրել էին Սահմանադրական դատարան, վիճարկում էր Քրեական դատավարության օրենսգրքի այն նորմը, որը հնարավորություն չէր ընձեռում կողմին բողոքարկելու առաջին ատյանի դատարանի կողմից կայացրած որոշումը, որը վերաբերում էր քաղաքացիական հայցը վարույթ ընդունելուց հրաժարվելուն: ՍԴ-ն վարույթ էր ընդունել նշված դիմումը, այնուհետև կարճել գործի վարույթը:

Երեկ մեզ հետ զրույցում փաստաբան Արամազդ Կիվիրյանն ասաց, որ դատարանները փաստարկել են, որ Քրեական դատավարության օրենսգիրքը հնարավորություն չի տալիս ներկայացնելու ոչ նյութական բնույթի պահանջ: Այսինքն՝ Քրեական դատավարության շրջանակներում հնարավոր է ներկայացնել բացառապես նյութական բնույթի պահանջ, այլ ոչ՝ ոչ նյութականի: Սա է հիմնական խնդիրը, որը տվյալ դեպքում առաջացել էր գործի քննության ընթացքում, երբ դիմումատուները զրկվել էին ոչ նյութական բնույթի պահանջ ներկայացնելու հնարավորությունից: Տվյալ դեպքում ՍԴ-ում քննության առարկա է հանդիսանալու այն հարցադրումը, թե արդյո՞ք անձը քրեական դատավարության շրջանակներում հնարավորություն ունի՞ ներկայացնելու ոչ նյութական վնասի հատուցման պահանջ, թե՞ ոչ: Հիմնական հարցը դրանում է»,- ասաց փաստաբանը»,-գրում է թերթը:
