ՊԵԿ-ը հայտարարություն է տարածել ԵԱՏՄ տարածքում մտավոր սեփականության օբյեկտների նկատմամբ իրավունքների պահպանության հարցի վերաբերյալ

ՀՀ կառավարությանն առընթեր պետական եկամուտների կոմիտեն հայտարարություն է տարածել ԵԱՏՄ տարածքում մտավոր սեփականության օբյեկտների նկատմամբ իրավունքների պահպանության և պաշտպանության առնչությամբ: Այս մասին «Արմենպրես»-ին տեղեկացրին ՀՀ ԿԱ ՊԵԿ լրատվական ծառայությունից:
«ՀՀ կառավարությանն առընթեր պետական եկամուտների կոմիտեն հիշեցնում է, որ 2018թ. հունվարի 1-ից Հայաստանի Հանրապետության համար ուժի մեջ է մտնելու «Եվրասիական տնտեսական միության մասին» պայմանագրի «Մտավոր սեփականության օբյեկտների նկատմամբ իրավունքների պահպանության և պաշտպանության մասին» արձանագրության 5-րդ բաժնի 16-րդ կետը, համաձայն որի՝ անդամ պետությունների տարածքներում կիրառվում է ապրանքային նշանի նկատմամբ բացառիկ իրավունքի սպառման սկզբունքը: Սկզբունքի համաձայն՝ տվյալ ապրանքային նշանի օգտագործումն այն ապրանքների առնչությամբ, որոնք իրավաչափորեն դրվել են քաղաքացիական շրջանառության մեջ ցանկացած անդամ պետության տարածքում՝ անմիջականորեն ապրանքային նշանի իրավատիրոջ կամ վերջինիս համաձայնությամբ այլ անձանց կողմից, ապրանքային նշանի նկատմամբ բացառիկ իրավունքի խախտում չի համարվում: Հետևաբար, այլ անձանց կողմից առանց ապրանքային նշանի իրավատիրոջ համաձայնության տվյալ ապրանքային նշանի օգտագործումը, այդ թվում՝ «զուգահեռ ներմուծումը», կարող է համարվել ապրանքային նշանի նկատմամբ բացառիկ իրավունքի խախտում և կարող է հանգեցնել համապատասխան իրավական հետևանքների: Ելնելով վերոգրյալից՝ առաջարկում ենք այն տնտեսվարող սուբյեկտներին, որոնք մաքսային սահմանով տեղափոխում են վերադաս մաքսային մարմնի կողմից վարվող մտավոր սեփականության օբյեկտների ռեեստրում գրանցված ապրանքային նշաններով մակնշված ապրանքներ, ձեռք բերել ապրանքային նշանի իրավատիրոջ համաձայնությունը կամ թույլտվությունը ապրանքների տեղափոխման ժամանակ հնարավոր բարդություններից խուսափելու համար»,- նշված է ՊԵԿ հայտարարության մեջ:
