ՄԻԵԴ վճիռը կատարելու քաղաքական ճնշման մեխանիզմներն աշխատելու են
POLITICSՎերջերս Եվրոպայի խորհուրդը Ադրբեջանին պաշտոնապես տեղեկացրել էր անդամակցության հնարավոր կասեցման մասին: Գործընթացը կապված է «Իլգար Մամմադովն ընդդեմ Ադրբեջանի» Մարդու իրավունքների եվրոպական դատարանի վճռի չկատարման հետ։
Ավելի ուշ Եվրոպայի խորհրդի նախարարների կոմիտեն Ադրբեջանին տեղեկացրել էր իրավական գործընթաց սկսելու մտադրության մասին՝ «Իլգար Մամեդովն ընդդեմ Ադրբեջանի» գործով ՄԻԵԴ վճիռը չկատարելու առնչությամբ: Հավելենք, որ Ադրբեջանի իշխանություններին մինչև նոյեմբերի 29–ը ժամանակ էր տրված ընդդիմադիր քաղաքական գործչին ազատ արձակելու համար: Ադրբեջանը, սակայն, մինչ օրս շարունակում է չկատարել ՄԻԵԴ վճիռը:
Փաստաբան Արա Ղազարյանի խոսքով, նման վարույթ առաջին անգամ է կիրառվում:
«Այսինքն՝ առաջին անգամ է, որ պետության դեմ դատական գործ է հարուցվում վճիռը չկատարելու համար: Ադրբեջանը ձևականորեն չի հրաժարվում վճիռը կատարելուց: Ուղղակի ասում է՝ որպեսզի կարողանամ վճիռը կատարել, պետք է օրենքս փոխեմ:
Օրենքը փոխում են, բայց օրենքը փոխելու գործընթացն արդեն բավականին երկար է տևում: Արդեն Քրեական օրենսգրքի երկու ընթերցում է եղել Ադրբեջանի ազգային ժողովում: Շուտով երրորդ ընթերցումը կլինի, օրենքը կընդունեն, ուժի մեջ կմտնի, կկիրառեն ու նոր ազատ կարձակեն Իլգար Մամեդովին»,– «Փաստ»–ի հետ զրույցում ասաց Արա Ղազարյանը՝ միաժամանակ հավելելով, որ այս ձևական մոտեցումը շատ պետությունների մոտ է ընդունված:
