ԿԸՀ-ն պատշաճ պատասխան չի տրամադրել ՀՔԱՎ-ի առաջարկներին. դատարանը դա իրավաչափ է համարել

ՀՀ Աժ 2017 թ. ապրիլի 2-ի ընտրությունների նախընտրական քարոզչության ընթացքում տեղի ունեցած խախտումների վերաբերյալ ՀՔԱ Վանաձորի գրասենյակը պարբերաբար վարչական վարույթ հարուցելու առաջարկություններ է ներկայացրել ՀՀ Կենտրոնական ընտրական հանձնաժողով: Այս մասին հայտնում է Հելսինկյան քաղաքացիական ասամբլեայի Վանաձորի գրասենյակը:
Հանձնաժողովը դրանք դիտարկել է որպես դիմումներ և մերժել վարույթի հարուցումը: ՀՔԱ Վանաձորի գրասենյակը ԿԸՀ անգործությունը վիճարկում է դատարանում:
2017 թ. մարտի 18-ին ՀՔԱ Վանաձորի գրասենյակը առաջարկներ է ներկայացրել ՀՀ վարչապետ Կարեն Կարապետյանի աշխատանքային ժամերին անցկացրած նախընտրական քարոզչության, Գագիկ Ծառուկյանի ու Առաքել Մովսիսյանի կողմից նախընտրական խոստումներ տալու և Արագածոտնի մարզի Ծաղկահովիտ համայնքի համայնքապետարանի շենքում ՀՀԿ ընտրական շտաբ տեղակայելու մասին: 2017 թ. մարտի 25-ի որոշումներով ՀՀ Կենտրոնական ընտրական հանձնաժողովը աշխատանքային ժամին վարչապետի քարոզչություն իրականացնելն ու համայնքապետարանի շենքում ՀՀԿ ընտրական շտաբի տեղակայումը իրավաչափ է համարել, իսկ Գագիկ Ծառուկյանի ու Առաքել Մովսիսյանի մասով հայտնել, որ նրանք արդեն նախազգուշացվել են:
Մինչդեռ ՀՀ ընտրական օրենսգրքի 19-րդ հոդվածի համաձայն՝ նախազգուշացումը պատասխանատվության միջոց չէ, պատասխանատվության միջոց կարող է սահմանել միայն դատարանը՝ ԿԸՀ հայցի հիման վրա: Եվս մեկ առաջարկի մասով ԿԸՀ-ն եզրակացրել է, որ Կազմակերպության իրավունքները չեն խախտվել, և նման բովանդակությամբ դիմումներ ներկայացնելու իրավունք վերջինս չունի: Մինչդեռ ՀՀ Սահմանադրության 53-րդ հոդվածի համաձայն՝ յուրաքանչյուր ոք կարող է առաջարկություններ ներկայացնել պետական մարմիններին, և Կենտրոնական ընտրական հանձնաժողովը պարտավոր էր օրինական և հիմնավոր պատասխան ներկայացնել:
Ընդ որում՝ վերոնշյալ դիմումների միայն մի մասի քննարկմանն է Կազմակերպության ներկայացուցիչը ներկա եղել, մյուսները քննարկվել են վերջինիս բացակայությամբ: Ներկայացված դիմում-առաջարկներին պատշաճ պատասխան տրամադրելու և ԿԸՀ որոշումներն անվավեր ճանաչելու հարցով ՀՔԱ Վանաձորի գրասենյակը 2017 թ. ապրիլի 6-ին դիմել է դատարան: ՀՀ Վարչական դատարանը հայցը վարույթ է ընդունել միայն առաջին մասով և այն քննել 2017 թ. նոյեմբերի 28-ին, իսկ դեկտեմբերի 5-ին վճռել է հայցը մերժել:
