Կաշառքի դիմաց վարորդական իրավունք տրամադրելու գործը՝ դատարանում

Մեղադրական եզրակացությամբ ավարտվել է կաշառքով վարորդական իրավունքի վկայական ստանալու վերաբերյալ քննված քրեական գործի նախաքննությունը:

Այս առնչությամբ, ՀՔԾ-ի տարածած հաղորդագրության մեջ ասվում է.

«Կաշառք ստանալու, կաշառքի միջնորդության եւ պաշտոնեական կեղծիք կատարելու փաստերով ՀՀ հատուկ քննչական ծառայությունում քննված քրեական գործով կատարված նախաքննությամբ հիմնավորվել է, որ ՀՀ ոստիկանության «Ճանապարհային ոստիկանություն» ծառայության Կոտայքի հաշվառման-քննական բաժանմունքի տեսուչ Կարեն Չոբանյանը, Ն. Մ.-ին վարորդական իրավունքի վկայական տալու համար անհրաժեշտ քննությունները «դրական» գնահատելու դիմաց, երկու անձի միջնորդությամբ կաշառք է ստացել եւ պաշտոնեական կեղծիք կատարել, որի հետեւանքով  ավտոմեքենա վարելու հմտություններին չտիրապետող անձը ստացել է վարորդական իրավունքի վկայական:

Այսպես, 2017թ. մայիսի 16-ին` Ն. Մ.-ն, վարորդական իրավունքի վկայական ստանալու նպատակով դիմել է իր ծանոթ, «Աբովյան տեխնիկական դպրոց» ընկերության գործնական վարման վարպետ Ալբերտ Կուրանյանին, ով վստահեցրել է, որ իր միջնորդությամբ ՀՀ ոստիկանության համապատասխան պաշտոնատար անձանց կաշառք տալու դեպքում քննությունները ձեւական բնույթ կկրեն:

Ն. Մ.-ն, հասկանալով, որ համապատասխան գիտելիքներ չունեցող անձին վարորդական վկայական տրամադրելը կարող է վտանգավոր հետեւանքներ առաջացնել, դրանք կանխելու նպատակով դիմել է ՀՀ ազգային անվտանգության ծառայությանը, որի կողմից ձեռնարկված օպերատիվ-հետախուզական միջոցառման շրջանակներում հիշյալ քաղաքացին կաշառքի գումարը տվել է Ա. Կուրանյանին եւ վերջինիս ուղեկցությամբ գնացել «Ճանապարհային ոստիկանության» Կոտայքի հաշվառման-քննական բաժանմունք:

Ա. Կուրանյանը նախապես իրենց այցելության մասին տեղեկացրել է նշված հաշվառման-քննական բաժանմունքում տեղադրված վճարային համակարգերի սպասարկմամբ զբաղվող Անդրանիկ Պապիկյանին, ով Ա. Կուրանյանից վերցրել է կաշառքի գումարն ու Ն. Մ.-ին ուղեկցել հաշվառման-քննական բաժանմունք: Այնտեղ հիշյալ բաժանմունքի տեսուչ Կարեն Չոբանյանը Ա. Կուրանյանի ու Ա. Պապիկյանի միջնորդությամբ ստացել է կաշառքի գումարը, որի դիմաց, տեսական քննության ժամանակ Ն. Մ.-ի կողմից հարցերին սխալ պատասխանելուց հետո, ինքն է կատարել անհրաժեշտ շտկումները, այնուհետեւ շահադիտական նպատակներով կազմել եւ ստորագրել է տեսական քննություն արդյունքների վերաբերյալ կեղծ տեղեկություններ ներառող արձանագրություն` այդ կերպ ապահովելով գործնական քննությանը Ն. Մ.-ի մասնակցությունը:

Այնուհետեւ վերջինս մասնակցել է գործնական քննությանը, որի ընթացքում սահմանված կարգով չի կատարել առաջադրված վարժությունները, սակայն տեսուչ Կ. Չոբանյանը գործնական քննությունը նույնպես գնահատել է «դրական»: Արդյունքում` նույն օրը, անհրաժեշտ տեսական գիտելիքներ չունեցող եւ ավտոմեքենա վարելու հմտություններին չտիրապետող Ն. Մ.-ին տրվել է «B» կարգի վարորդական իրավունքի վկայական: 

Այսպիսով, կաշառք ստանալու եւ պաշտոնեական կեղծիք կատարելու համար ՀՀ ոստիկանության «Ճանապարհային ոստիկանություն» ծառայության Կոտայքի հաշվառման-քննական բաժանմունքի տեսուչ Կ. Չոբանյանին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 311-րդ հոդվածի 2-րդ մասով եւ 314-րդ հոդվածի 1-ին մասով, իսկ կաշառքի միջնորդության համար Ա. Կուրանյանին եւ Ա. Պապիկյանին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 313-րդ հոդվածի 1-ին մասով: Կ. Չոբանյանի եւ Ա. Կուրանյանի նկատմամբ որպես խափանման միջոց է ընտրվել կալանավորումը:

Քրեական գործի նախաքննությունն ավարտվել է: Գործը մեղադրական եզրակացությամբ հանձնվել է դատավարական հսկողություն իրականացնող դատախազին՝ այն հաստատելու եւ դատարան ուղարկելու համար:
