Կառավարության կառուցվածքի մասին օրենքի նախագիծն ընդունվեց

ՀՀ կառավարությունը հավանություն տվեց «Կառավարության կառուցվածքի և գործունեության մասին» Հայաստանի Հանրապետության օրենքի նախագծին:

ՀՀ արդարադատության նախարար Դավիթ Հարությունյանը նշեց, որ Սահմանադրությունը նորովի կարգավորում ունի, որով անհրաժեշտ է հստակեցնել նախարարությունների ցանկը և կառավարության գործունեության կարգը:

«Ներկայում այդ հարցը կարգավորվում է երկու ակտով՝ կառավարության գործունեությունը կանոնակարգվում է նախագահի հրամանագրով, իսկ նախարարությունների ցանկը սահմանվում է օրենքով: Ո՞րն է հիմնական կարգավորումը, որ մենք առաջարկում ենք:

Կառավարությունը կազմավորված է վարչապետից, առաջին փոխվարչապետից, երկու փոխվարչապետներից և նախարարներից: Ընդ որում, կառավարությունը համարվելու է կազմավորված, եթե նշանակվել են կառավարության անդամների առնվազն 2/3-ը»,-, ասաց Հարությունյանը:

Իր խոսքում նա ավելացրեց նաև, որ  Սահմանադրությունը նախատեսել է մի շարք դրույթներ, թե ինչ ժամկետում պետք է առաջարկվեն կառավարության անդամների թեկնածուները, որն է վերջնաժամկետը, որպեսզի կառավարությունը ձևավորվի:

«Որոշակի ժամկետներ պայմանավորված են հենց կառավարության ձևավորված լինելու փաստով՝ դրա համար ամրագրել ենք այդ 2/3-րդ թիվը: Նախատեսում ենք, որ կառավարության կառուցվածքում ընդգրկվելու են 18 նախարարություններ և օրենքում նախատեսում ենք հավելվածի տեսքով նրանց գործունեության հիմնական ոլորտները, հակառակ դեպքում ուղղակի անունների թվարկումը կարծում ենք օրենքը կդարձներ ավելի թերի:

Սահմանում ենք կառավարության անդամի կողմից նոր պահանջ՝ երդում տալու պահանջը, հաշվի առնելով այն հանգամանքը, որ պատգամավորները, դատական իշխանության ներկայացուցիչները տալիս են երդում, նախատեսում ենք նաև կառավարության անդամների համար»,- ասաց նախարարը:

Նա հավելեց նաև, որ սահմանվել են այն դեպքերը, որոնց պարագայում վարչապետը պարտավոր է հրաժարական ներկայացնել :

Մասնավորապես, երբ ձեռք է բերել այլ պետության քաղաքացիություն կամ խախտվել են օրենքում նախատեսված անհամատեղելիության պահանջները, ապա օրենքի ուժով պարտավոր է ներկայացնել հրաժարական:

«Ի տարբերություն կառավարության աշխատակազմի՝ նախատեսել ենք վարչապետի աշխատակազմ, որը կոչված է ծառայելու վարչապետին, փոխվարչապետներին, նաև վարչապետի լիազորությունների հետ կապված կառավարության նիստերի անցկացում և այլն, այդ բոլոր հարցերը պետք է լուծի վարչապետի աշխատակազմը, բնականաբար իր կազմում ունենալով տարբեր ստորաբաժանումներ»,- ընդգծեց նախարարը:
