«Փաստ» օրաթերթը գրում է

 

Դատական օրենսգրքից հանվեցին փաստաբանների նկատմամբ կիրառվող տուգանքները՝ դրանք տեղափոխելով Դատավարական օրենսգիրք: Ըստ արդարադատության նախարար Դավիթ Հարությունյանի՝ դատախազների ու փաստաբանների նկատմամբ տուգանքի կիրառման փորձ չկար, և լրացուցիչ պաշտպանիչ մեխանիզմներ մտցնելու համար անհրաժեշտ էր լինում լրացուցիչ ժամկետների բողոքարկում և այլն, ինչը սահմանադրական օրենքի մակարդակով փոփոխություն կատարելու համար դժվարություններ էր ստեղծում: Այժմ այդ ամենից խուսափելու ու փոփոխություններ կատարելու համար նորմերը տեղափոխել են Դատավարական օրենսգիրք:

Փաստաբանների պալատի նախագահ Արա Զոհրաբյանի խոսքով՝ այդ առաջարկը միջանկյալ լուծում է, ժամանակ փաստարկները ներկայացնելու համար:

Համաձայն ՀՀ արդարադատության նախարարության մշակած նախագծի՝ տուգանքի որոշումն ուժի մեջ է մտնում կայացման պահից:

Փաստաբան Արմեն Ադամյանը «Փաստի» հետ զրույցում նշեց, որ այս դեպքում նույն բանը մի դաշտից տեղափոխվում է մեկ այլ դաշտ, ընդ որում այն արդեն իսկ դատավարական իմաստով կարգավորվում է: Վերջինս այս տեղափոխության իմաստը չի հասկանում՝ պատճառաբանելով, որ մեխանիզմներ չկան, բացի այդ դեռ չգիտեն, թե ինչ փոփոխություններ կլինեն ի վերջո:

«Դատավորի կողմից համապատասխան սանկցիայի, մասնավորապես՝ տուգանքի կիրառման առումով փաստաբանի նկատմամբ կարգ, որպես այդպիսին, սահմանված է ներկայի Քրեական դատավարական օրենսգրքով: Որևէ կերպ հիմնավորվածությունը չեմ կարողանում ընկալել: Ավելին՝ կրկին չկա նախագիծ, որտեղ հստակ լինի, թե ինչ մեխանիզմ է մշակվում և ինչն է նպատակը: Եթե նպատակը տուգանքն է, ապա նույն տուգանքը կա: Դա նշանակում է, որ իրենք էլի անում են այն, ինչ ուզում են, ուղղակի դատավորներին այդքան լիազորություններ չեն տալիս: Իսկ դատավարության ընթացակարգը հստակ սահմանված է, ընդ որում նշվում է, թե որ դեպքերում է դատավորը իրավասու համապատասխան սանկցիաների կիրառման միջնորդությամբ հանդես գալու դատարանում»,– նշեց նա:

Հարցին, թե հետագա ի՞նչ քայլեր են ձեռնարկելու, եթե վերջնական որոշումը կրկին ոտնահարի իրենց իրավունքները՝ փաստաբանը պատասխանեց, թե երբ կներկայացնեն փոփոխությունները, այն ժամանակ էլ կորոշեն: Սա իրենց իրավունքների հարցն է: Կա մրցակցության հավասարություն: Ասում է՝ թող բարի լինեն այդ ամենը ապահովել:

«Ինձ համար ցավալի, է, որ մեր երկիրը եվրադատարաններում անընդհատ պարտություն է կրում: Մենք այդքան հարուստ չենք, որ դատական սխալի կամ մի այլ միջադեպի պատճառով նման կորուստներ ունենանք:

2016–17 թթ. վերլուծություններն եմ նայել, որտեղ նշված է, թե դատավորների նկատմամբ ինչ կարգապահական վարույթ կամ ինչ տույժ–տուգանքներ են սահմանվել: Ուղղակի զավեշտ է: 2017 թ. միայն մեկ դատավորի նկատմամբ աշխատավարձի 20%–ի պահում և մեկի նկատմամբ էլ վարույթ կարճելու որոշում է եղել: Եթե դատական իշխանությունը փորձում ենք հզորացնել և դատավորին դարձնել առավել ինքնուրույն, ամեն դեպքում այսօր երաշխիք էլ չկա, որ նրանք կամայականությունից կարող են զրկվել»,– եզրափակեց Ադամյանը:

Հիշեցնենք, որ ըստ նախագծի՝ փաստաբանների ու դատախազների նկատմամբ որպես սանկցիա կարող էր կիրառվել մինչև 100 հազար դրամի չափով տուգանք:
