ՀՀ հատուկ քննչական ծառայությունում քրեական գործեր են հարուցվել ՀՀ քննչական կոմիտեի և ՀՀ ոստիկանության պաշտոնատար անձանց կողմից քրեական գործով ապացույց կեղծելու, պաշտոնեական դիրքը չարաշահելու և ցուցմունք տալուն հարկադրելու առերևույթ հանցագործությունների առթիվ, տեղեկացնում է ՀՔԾ լրատվական ծառայությունը:

12.01.2018թ.-ին` Երևան քաղաքի Մալաթիա-Սեբաստիա վարչական շրջանի ընդհանուր իրավասության դատարանում, զենքի գործադրմամբ խուլիգանության դեպքի վերաբերյալ քննվող քրեական գործի դատաքննության ընթացքում, վկա Հ. Մ.-ն հայտարարել է, որ նշված քրեական գործով նախաքննություն իրականացնող` ՔԿ Մալաթիա-Սեբաստիա վարչական շրջանի քննչական բաժնի քննիչը կեղծել է իր ցուցմունքները` դրանցում ավելացնելով իրականությանը չհամապատասխանող տվյալներ:  Բացի այդ, Հ. Մ.-ն հայտնել է, որ քննիչի մոտ հարցաքննության է ներկայացել ցերեկվա ժամերին, մինչդեռ վերջինս ցուցմունքներում այլ ժամեր է նշել:

ՀՀ քննչական կոմիտեի պետական հատուկ ծառայություն իրականացնող պաշտոնատար անձի կողմից ծանր հանցագործության վերաբերյալ քրեական գործով ապացույց կեղծելու վերը նշված առերևույթ հանցագործության դեպքի առթիվ ՀՀ հատուկ քննչական ծառայությունում քրեական գործ է հարուցվել ՀՀ քրեական օրենսգրքի 349-րդ հոդվածի 3-րդ մասի 1-ին կետի հատկանիշներով:

Մյուս քրեական գործն էլ հարուցվել է ՀՀ քննչական կոմիտեի Շենգավիթ վարչական շրջանի քննչական բաժնի քննիչի կողմից ցուցմունք տալուն հարկադրելու` ՀՀ քրեական օրենսգրքի 341-րդ հոդվածի 1-ին մասով նախատեսված առերևույթ հանցագործության դեպքի առթիվ:

Այսպես, համաձայն քրեական գործի նյութերի` ՀՀ ԱՆ «Դատապարտյալների հիվանդանոց» քրեակատարողական հիմարկի կալանավոր Ս. Հ.-ն հաղորդում է տվել, որ իր վերաբերյալ քննված քրեական գործի նախաքննության ընթացքում ՔԿ Շենգավիթ վարչական շրջանի քննիչն իր նկատմամբ ճնշումներ և սպառնալիքներ է գործադրել, որի հետևանքով իրեն մեղսագրված ավազակության երկու դեպքերի վերաբերյալ իրականությանը չհամապատասխանող խոստովանական ցուցմունքներ է տվել և հրաժարվել պաշտպան ունենալուց:

Մեկ այլ ՀՀ քաղաքացի` Թալին քաղաքի բնակիչ Հ. Ե.-ն, հայտնել է, որ 2017 թվականի հոկտեմբերին իր այգուց կատարված 650 կիլոգրամ խնձորների գողության վերաբերյալ հաղորդում է տվել ՀՀ ոստիկանության Թալինի բաժնում: Այնտեղ նյութերի նախապատրաստման ընթացքում հետաքննիչը Հ. Ե.-ին ուղղորդել է լրացուցիչ բացատրությունում 650 կգ-ի փոխարեն նշել 50 կգ, որպեսզի գողություն կատարած անձը` Հ. Ե.-ի համաքաղաքացին, չդատապարտվի:

ՀՀ ոստիկանության հետաքննիչի կողմից պաշտոնեական դիրքը չարաշահելու հիշյալ դեպքի առթիվ ՀՀ հատուկ քննչական ծառայությունում քրեական գործ է հարուցվել ՀՀ քրեական օրենսգրքի 308-րդ հոդվածի 1-ին մասի հատկանիշներով:

Վերը նշված բոլոր քրեական գործերով կատարվում է նախաքննություն: 

 

Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
