Նոր բացահայտված դրվագներով՝ պաշտոնատար անձինք են կալանավորվել

ՀՀ հատուկ քննչական ծառայությունում քննվող` «Հայանտառ» ՊՈԱԿ-ի տարբեր անտառտնտեսություններում ծառերի ապօրինի հատման, պաշտոնեական դիրքի չարաշահման, կաշառք ստանալու և կաշառք տալու դեպքերի վերաբերյալ քննվող քրեական գործի նախաքննության ընթացքում բացահայտվել են պաշտոնատար անձանց կողմից կաշառք ստանալու նոր դրվագներ:

Հիշյալ քրեական գործի շրջանակներում ևս 2 անձ  ներգրավվել է որպես մեղադրյալ կաշառք ստանալու, կաշառք տալու և ապօրինի ծառահատումներ իրականացնելու համար: Այս մասին Past.am-ին տեղեկացնում են ՀՔԾ լրատվական ծառայությունից:

Գործի նախաքննության ընթացքում իրականացված մի շարք քննչական և այլ դատավարական գործողությունների արդյունքում պարզվել է, որ «Հայանտառ» ՊՈԱԿ-ի «Արծվաբերդի անտառտնտեսություն» մասնաճյուղում ապօրինի ծառահատումներ իրականացնելու թողտվության համար հիշյալ անտառտնտեսության պաշտոնատար անձինք՝ խմբով, նախնական համաձայնությամբ, 5 դրվագով ստացել են կաշառք:

Քրեական գործով ձեռք բերված փաստական տվյալների համաձայն` 2017 թվականի սկզբներին, «Արծվաբերդի անտառտնտեսություն» մասնաճյուղի պաշտոնատար անձինք Գ.Ս.-ի հետ պայմանավորվածություն են ձեռք բերել` վերջինիս օգտին ակնհայտ ապօրինի անգործություն դրսևորելու համար և թույլ են տվել նրան անտառտնտեսության անտառային ֆոնդի տարածք հանդիսացող պահաբաժնում տարբեր տեսակի ծառերի ապօրինի հատումներ իրականացնել և իրացնել, որի համար ստացել են կաշառք:

Պայմանավորվածության համաձայն` Գ. Ս.-ն 2017 թվականի փետրվարից մարտն ընկած ժամանակահատվածում` 5 տարբեր օրերի, իր կողմից հավաքագրված մի խումբ անձանց հետ անտառային պահաբաժնում ապօրինի հատել են տարբեր տեսակի ծառեր, իսկ փայտանյութը բեռնատար ավտոմեքենայով տեղափոխել անտառային տարածքից և իրացրել:

Ապօրինի ծառահատում իրականացնելու և փայտանյութն իրացնելու յուրաքանչյուր դեպքում վերը նշված անտառտնտեսության պաշտոնատար անձինք` խմբով, նախնական համաձայնությամբ, Գ. Ս.-ից պահանջել և ստացել են կաշառք:

Այսպիսով, խմբով` նախնական համաձայնությամբ կաշառք ստանալու համար պաշտոնատար անձանցից Հ. Խ.-ին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 311-րդ հոդվածի 3-րդ մասի 2-րդ կետով (5 դրվագով): Նրա նկատմամբ որպես խափանման միջոց է կիրառվել կալանավորումը:

Ապօրինի ծառահատում իրականացնելու և կաշառք տալու համար Գ. Ս.-ին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 296-րդ հոդվածի 1-ին մասով և ՀՀ քրեական օրենսգրքի 312-րդ հոդվածի 2-րդ մասով (5 դրվագով): Նրա նկատմամբ որպես խափանման միջոց է կիրառվել կալանավորումը, որը փոխարինվել է այլընտրանքային խափանման միջոցով՝ գրավով:

Ինչպես ՀՀ հատուկ քննչական ծառայությունն արդեն տեղեկացրել է, վերը նշված քրեական գործի շրջանակներում բացահայտվել են նաև ՀՀ բնապահպանության նախարարության նախկին բնապահպանական պետական տեսչության պաշտոնյաների կողմից խմբով` նախնական համաձայնությամբ անտառապետերից կաշառք ստանալու, պաշտոնեական դիրքը չարաշահելու և պաշտոնեական կեղծիք կատարելու դեպքեր: Նշված քրեական գործով քննության ներկա փուլում ընդհանուր առմամբ 13 անձինք ներգրավվել են որպես մեղադրյալ:

Նախաքննությունը շարունակվում է: 

 

Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
