Հայաստանի դեմ ՄԻԵԴ վճիռների գործերը քննած դատավորները պատասխանատվության կենթարկվեն
POLITICSՀայաստանի դեմ Մարդու իրավունքների եվրոպական դատարանի վճիռների հիման վրա տվյալ դատական գործը քննած դատավորները կենթարկվեն պատասխանատվության:
Այս մասին, այսօր ԱԺ-ում Դատական օրենսգրքի երկրորդ ընթերցմամբ քննարկմանն ասաց ՀՀ ԱԺ ՀՀԿ խմբակցության պատգամավոր, ՄԻԵԴ-ում ՀՀ ներկայացուցիչ Գևորգ Կոստանյանը:
«Պետական կառավարման մեջ անպատասխանատու որևէ սուբյեկտի պաշտոնավարումը վտանգավոր է: Տասը տարուց ավելի է՝ ես Մարդու իրավունքների եվրոպական դատարանում Հայաստանի ներկայացուցիչն եմ ու եզրակացրել եմ՝ քանի դեռ մենք չենք բարձրացնում դատավորների պատասխանատվության հարցը, մեր ակնկալած որակի արդարադատություն չենք ունենա։
Առավոտից երեկո սեմինարներ անենք դատավորների համար, գիշեր-ցերեկ կոնֆերանսներ անենք, վերապատրաստենք, չգիտեմ՝ ինչեր անենք, միևնույնն է, արդյունք չի տալու։ Հետևաբար՝ ես սկզբունքորեն գտնում եմ, որ շատ կարևոր է, որ մենք բարձրացնենք դատավորների պատասխանատվության հարցը»,- նշեց նա։
Պատգամավորի խոսքով՝ Դատական օրենսգրքի նախագծով մանրամասն կարգավորվում է այդ հարցը։ Մասնավորապես՝ ՄԻԵԴ վճիռների հիման վրա, երբ ճանաչվում է խախտման փաստը, դատավորը պետք է ենթարկվի պատասխանատվության։ Այսինքն՝ ՄԻԵԴ վճիռը կարող է հիմք հանդիսանալ դատավորի նկատմամբ կարգապահական վարույթ հարուցելու համար։
ԱԺ «Ելք» խմբակցության պատգամավոր Արտակ Զեյնալյանը նկատեց, որ ՄԻԵԴ հասնելու համար քաղաքացին պետք է սպառի հայաստանյան երեք դատական ատյանները՝ առաջին ատյանի դատարան, Վերաքննիչ դատարան, Վճռաբեկ դատարան և հետաքրքրվեց.
«Ո՞ր դատավորն է ենթակա պատասխանատվության կոնվենցիայի դրույթը խախտելու համար»։
Ի պատասխան Կոստանյանն ասաց, որ բոլոր ատյանների դատավորներն էլ, ովքեր ներգրավված են եղել այդ գործում, ենթակա են պատասխանատվության։
